Comments:
An unannounced Complaint Inspection was initiated in the center on July 26, 2018, continued on July 31, 2019 and completed on August 19, 2019 regarding a complaint received by the department related to staff supervision. Based on observation and interviews with staff and other parties involved, there is a preponderance of evidence to support the allegation regarding a staff to child ratio issue that poses a health and safety risk to the children, therefore the complaint has been determined to be VALID.
Violations not related to the compliant were cited and noted on the violation notice.

The results of the inspection were reviewed and verified with the center director during the exit interview.

Complaint related: Yes
Description: Based on observation, documentation review and staff interviews, the licensee did not ensure when children are regularly in ongoing mixed age groups, the staff-to-children ratio applicable to the youngest child in the group shall apply to the entire group.

Evidence: There was a mix age group of children on the following days and the center staff did not follow the ratio requirements for the youngest child.
1) On the morning of July 26, 2019 in the front lobby/classroom there was 1 staff with 10 children, the age range was 19 months (child #1) to age 10 (child #2) between 7:00 am and 8:00 am. The ratio for children age 19 months is 1 staff for every 5 children.
2) On July 26, 2019 in the two year old room there were 2 staff with 10 children the age range was 13 months (child # 3) to age 5 (child #4) between 7:00 am and 8:00 am. The ratio for children age 13 months is 1 staff for every 4 children.
3) On July 31, 2019 in the two year old room there was 1 staff with 10 children, the age range was 2 years (child # 5) to age 4 (child #6) between 7:00 am and 8:00 am. The ratio for children age 2 is 1 staff for every 8 children.
Center staff confirmed the ages and number of children in care observed.

Plan of Correction: The center director will ensure student to teacher ratios are met on a daily basis related to drop off times for children in care.

Description: Based on observation, staff interviews and documentation review, the licensee did not ensure all materials and equipment available shall be age and stage appropriate for the children.

Evidence: On 7-26-2019, child #2, age 10 was observed playing a "M"rated video game and it was rated "M" for intense graphic violence, language and it is listed as suitable for those 18 and over. Schoolage children age range from 5 to age 10 were in the room while the game was being played with a video game console and a television screen.

Description: Based on staff interviews and documentation review, the licensee did not ensure the center shall maintain a written record of children's serious and minor injuries in which entries are made the day of occurrence and included all required information.

Evidence:
Center staff reported child #7 was injured on 7-15-2019 and child #8 was injured on 7-19-19 at the center and both child #3 and child #4 required medical treatment. On 7-26-2019 during inspection the center director confirmed there were not injury reports available for review.
