Comments:
The licensing inspector conducted an unannounced monitoring inspection on 06/18/2019. The inspection was in response to a self-reported incident that was received in the Valley Licensing Office on 06/09/2019. The on-site portion of the inspection was conducted on June 18, 2019. The inspection was in regards to the licensing standards relating to the care and protection of children in care. Areas of non-compliance may be found on the violation notice.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and returned it to me within five (5) business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word ?corrected? is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

This inspection was report was amended on August 20, 2019 and reissued on August 20, 2019.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on interviews and documentation the center failed to comply with its own policies for behavior management.
Evidence:
1. Per center handbook "We do not use abusive, neglectful, corporal, humiliating or frightening punishment under any circumstances."
2. Staff #2 stated "She may have grabbed Child A's arm but did not recall leaving marks."
3. Staff #1 stated she saw Staff #2 "pick up a child by the arm and carry them across the room."
4. Staff #2 admitted to picking children up by one arm.
5. Staff #2 stated "it's no excuse for what I did but I was frustrated."

Plan of Correction: While Bright Beginnings contests these findings as unsupported by its own investigation, Bright Beginnings does recognize the value of adopting additional precautionary measures. All staff members to include management have been re-trained on the centers behavior management policy. In addition all staff have been re-trained on the VDSS standard for Behavior Guidance (22 VAC 40-185-400) as well as the VDSS Standard on Forbidden Actions (22 VAC 40-185-410).

Standard #: 22VAC40-185-80-B
Description: Based on interviews and documentation suspected child abuse was not reported in accordance with 63.2-1509 of the Code of Virginia.
Evidence:
1. Staff #1 stated she saw Staff #2 "picking up a child by the arm and carrying them across the room" and "left marks on a child after squeezing their arm."
2. Staff #1 believed Staff #2 was abusive to children in care.
3. Staff #1 reported suspected abuse to center management on March 29, 2019.
4. Suspected abuse was not immediately reported to Child Protective Services.

Plan of Correction: While Bright Beginnings contests these findings as unsupported by its own investigation, Bright Beginnings recognizes the value of adopting additional precautionary measures. All staff members to include management were re-trained on reporting suspected child abuse and mandated reporting using the VDSS online training titled: CWSE 5691: Recognizing and Reporting Child Abuse and Neglect for Educators. Staff involved in this violation were terminated

Standard #: 22VAC40-185-340-A
Description: Based on documentation and interviews the center failed to ensure the care, protection and guidance of children in care.

Evidence:
1. Staff #2 admitted to picking children up by one arm.
2. Staff #2 stated she "may have grabbed children but did not recall leaving marks."
3. Staff #1 stated she saw Staff #2 "pick up a child by the arm and carry them across the room."
4. The center took disciplinary action on March 29, 2019 for Staff #2 lifting children up by one arm.
5. Staff #2 was moved from the Monkey Room (ages 9-16 months) to the Lion Room (ages 0-9 months) and paired with a Mentor teacher to work on ?voice tone, and proper handling of our littlest friends.?
6. Suspected abuse was not immediately reported to Child Protective Services.

Plan of Correction: While Bright Beginnings contests these findings as unsupported by its own investigation, Bright Beginnings does recognize the value of adopting additional precautionary measures. All staff have been re-trained on behavior guidance in accordance to the VDSS Standard 22 VAC 40-185-400 as well as VDSS standard 22 VAC 40-185-410. All staff have been retrained in the philosophy and policy outlined by the center on behavior management. All staff members to include management were re-trained on reporting suspected child abuse and mandated reporting using the VDSS online training titled: CWSE 5691: Recognizing and Reporting Child Abuse and Neglect for Educators.

Standard #: 22VAC40-185-410-1
Description: Based on interviews and documentation one staff member roughly handled children in care.
Evidence:
1. Staff #2 stated "She may have grabbed Child A's arm but did not recall leaving marks."
2. Staff #1 stated she saw Staff #2 "pick up a child by the arm and carry them across the room."
3. Staff #2 admitted to picking up children by one arm.
4. Staff #2 stated "It's no excuse for what I did but I was frustrated."

All staff have been retrained in the philosophy and policy outlined by the center on behavior management. Staff involved in this violation were terminated.
In addition to the above stated responses and plans of correction, All centers have been equipped with cameras in each classroom and common areas. All directors have a monitor in the office with all cameras running during hours of operation. The owner and Directors also have camera access through their cellphones for viewing and audio when they are away from the building. The Main office also has a monitor for viewing during the hours of operation.
