Comments:
A complaint investigation was begun on July 16, 2019 in response to our office receiving information regarding a lack of supervision.
During the investigation, staff interviews were conducted, records and documents were reviewed. Based on the preponderance of evidence, the complaint is valid. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on staff interviews, staff did not follow the center's own policies and procedures.
Evidence:
1.The center's policy for feeding children states that all children are to use color coded place mats whenever they are being fed. Place mats were not used for two children when they were placed in high chairs and given crackers at approximately 6:00pm.
2. Staff that are not normally in the room are to read the posted allergy list prior to feeding children. Staff 1 stated she was not aware that the child's feeding restrictions included snacks.
3. Each classroom has a posted allergy list, and place mats for each child. Child A's red (for allergies) place mat indicates that he is not to have any food that is not brought from home, with the exception of fresh fruit and milk.

Description: ased on multiple interviews, while supervising children, staff did not ensure the care and protection of a child.
Evidence:
On 08/06/2019 at approximately 6:00pm, Staff 1 fed a school provided cracker to Child A (16 months). The child's record includes documentation of the child's allergies including wheat, and instructions that the child may not eat any food from the school with the exception of fresh fruit and milk. The child has a red place mat (indicating a food allergy) that is to be used whenever the child is fed: however, the place mat was not used when the child was fed a snack. Staff 1 stated she was aware that the child did have allergies, but did not use the mats. Staff 1 acknowledged she gave the child a school cracker containing wheat at approximately 6:00 PM. After being picked up by the parent, the child did have an allergic reaction including vomiting and a rash. The child was administered Diphenhydramine, was also administered an Epi-pen and transported to the emergency room via an emergency vehicle at approximately 6:30PM.
