Technical Assistance:
A volunteer means a person who works at the center and; 1) is not paid; 2) is not counted in the staff to children ratios; and 3) is in sight and sound supervision of a staff member when working with a child.
Any unpaid person not meeting this definition shall be considered "staff" and shall meet staff requirements.
A volunteer must not provide volunteer services until the center has the person's completed sworn statement of affirmation.

Comments:
A complaint was received involving a person working with children in the licensed program who did not have background checks. Interviews, observation, a review of staff files and record keeping were conducted and the complaint was determined to be valid.

Please submit your plan of correction to Licensing by close of business on 09/03/19.

Description: Based on interviews and a review of files and record keeping, it was determined that the center failed to ensure the care, protection and guidance of children in care.
Evidence:
On 7/18/19 approximately 23 children ( ages 11 and 12) went on a field trip to an amusement park with five staff , (Four Program Leaders, Assistant A, who was 16 years of age) and a Volunteer.

Two times during the field trip, Assistant A and the Volunteer left their assigned group and took children with them through the park despite being instructed by the Program Leaders to stay with their assigned group:

1) Assistant A and the Volunteer left their assigned group with approximately 5 to 6 children to get on rides at the park after being told by the Program Leader(s) to stay with their assigned group. The Program Leaders attempted to call Assistant A repeatedly to determine their location, however the calls were not answered. Eventually, Assistant A texted one of the Program Leaders and told them when and where to meet. Thirty minutes later Assistant A, the Volunteer, and the 5 to 6 children reunited within their assigned group.

2) The second time, Assistant A and the Volunteer took a group of 8 to 9 children for approximately 45 minutes after being instructed again to stay with their group.

3) During the field trip , the Volunteer was asked to go into the bathroom to retrieve a child who was slow to exit. The Volunteer went into the bathroom and escorted the child out, resulting in the Volunteer being alone with the child and not under the sight or sound supervision of staff. Staff interviews revealed that none of the staff were informed about the Volunteer's role or responsibilities on the field trip to include that the Volunteer must be in sight and sound supervision of a staff member when working with children.

Plan of Correction: We are providing an organizational training to go over field trip/club safety and policies around volunteerism. In this training we hope to accomplish clear lines of what is acceptable from our volunteers on field trips and while they are at the club. Any volunteers at the clubs will have to be cleared in advance with proper background checks and paperwork on file prior to them volunteering at the club.

Description: Based on interviews, it was determined that a qualified program leader was not regularly present in each grouping of children.
Evidence:
On 7/18/19, the Volunteer and Assistant A ( 16 years of age) were functioning as program leaders when they assumed the direct supervision of children and for implementation of the activities for children when they took two groups of 11 and 12 year old children for 1 hour and 15 minutes through the amusement park getting on and off rides.
Assistant A did not meet program leader qualifications to include age requirements, experience, training and education. The Volunteer was not a staff member, therefore had not received any training nor complete any of the background checks required for a program leader.

Plan of Correction: We have recently hired a new Assistant Daycare Director. This Assistant Daycare Director will serve as the lead program person on all field trips. If for some reason the Assistant Daycare Director is not available to attend, all staff attending the trip will know who the lead staff person in charge will be. If for any reason any issues arise during the trip the Lead Program Person/Assistant Daycare Director will report any issues to the Daycare Director immediately.

Description: Based on interviews and a review of record keeping and staff files, it was determined that Volunteer A was allowed to provide volunteer services prior to the center obtaining a completed sworn statement of affirmation.

Plan of Correction: All volunteers will have completed the proper background checks and proper paperwork prior to volunteering at the club.
