Comments:
An unannounced complaint investigation was conducted today. There were 25 children in care, with a total of 7 staff members assigned to their direct supervision. Staff interviews were completed today. In addition, staff records, the physical plant, classroom programming, staff training, and staff background checks were inspected today.

After careful review of all available information, this complaint was deemed not valid.

Violations:
Standard #: 22VAC40-185-340-D
Complaint related: No
Description: Based on staff interviews and a review of staff qualifications, it was determined that one class grouping is not operated by a Lead qualified staff person.
Evidence:
There is one staff member routinely assigned as the only staff person in the Ducks classroom. This person is not Lead qualified.

Plan of Correction: That room is currently separated by a movable barrier to create two separate programming areas. We will remove the barrier to form one classroom. There is already a Lead qualified staff person on one side of the room. That person will be the Lead for the larger group.

Standard #: 22VAC40-185-350-E-1
Complaint related: No
Description: Based on observations, it was determined that one classroom was temporarily operated beyond the required ratio of 1 staff:4 children.
Evidence:
For approximately 2 minutes, the Infant classroom was operated beyond the maximum allowable ratio of 1 staff:4 children. The Inspector observed one staff person step out of the classroom to walk down the hall. While she was out of the classroom for approximately 2 minutes, the classroom was operated with 2 staff:10children.

Plan of Correction: All staff will be reminded to call for a replacement if they need to leave the room.

Standard #: 22VAC40-185-360-A
Complaint related: No
Description: Based on various staff interviews, it was determined that the activities in one classroom are not consistently age-appropriate throughout the day.
Evidence:
Of the 8 children currently enrolled in the Leapfrogs classroom, two are potty trained; two are in the process of becoming potty trained; and four are still in diapers without working on becoming potty trained. The staff person in this classroom takes the children who are potty training to the bathroom approximately every 30 minutes throughout the day. Because the bathroom is not in the classroom and she is the only staff person in that room, when she takes the potty training children to the bathroom she has to take all of the children. In doing so, the children who are already potty trained and the children who are not in the process of potty training, are not engaging in age-appropriate activities at a rate of every 30 minutes throughout the day.

Plan of Correction: That class is separated in two groups by a movable barrier. We will remove the barrier to form one class. That way she can leave the room to take children to the bathroom, and still maintain ratios while she's gone.
