Comments:
The Licensing Inspector conducted an unannounced complaint inspection with the local agency on 8/2/19 and 8/26/19 in response to a complaint that was received in the Licensing office on 7/31/19 concerning the care and protection of children receiving care, nutrition, cleanliness and diapering. Observations were conducted, staff were interviewed, and documentation was reviewed during the investigation. Based on the information gathered during the investigation, the evidence supports the complaint and is deemed to be valid. The areas of non-compliance associated with the complaint is on the attached violation notice.

Standard #: 22VAC40-185-140-A
Complaint related: No
Description: Based on a review of five children's records, it was determined that the facility did not ensure that each child in attendance had a completed physical within one month of attendance. Evidence: 1. The record for child #1 (date of enrollment 5/9/19) did not contain a physical examination. 2. Staff #5 confirmed that the record for child #1 did not contain a physical examination, and that child #1 had been enrolled for more than 30 days.

Plan of Correction: The facility responded: Parents were contacted for all student records missing a physical and advised to provide information to the school.

Description: Based on a review of documentation and interviews, it was determined that the licensee failed to ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance. Evidence: 1. Child #1 (four months) was in care at the facility on 7/30/19 from 7:58am until 5:05pm. After picking up child #1, his parents noticed an open wound on his upper thigh resulting in a trip to the hospital, where they were informed it was a burn. 2. Staff #1 confirmed that the open wound was visible during the first two diaper changes and that she did not notify staff #3 (Program Director) or provide first aid treatment. 3. At the third diaper change for child #1, 11:53am according to the Daily Care Report, staff #3 saw the open wound and notified staff #5 (Program Director) about the injury on child #1 and showed it to her. 4. All staff interviewed confirmed that no first aid was provided for the open wound on child #1.

Plan of Correction: The facility responded: Child#1 arrived to the learning center the morning of 7/30/19 with the scar present. According to staff, the scar noticed on Child#1 appeared to be a diaper rash; Staff#1 documented on the Daily Care Report that the parents needed to provide diaper rash ointment for the student. Child#1 was not burned or injured in the facility. All staff members were trained on properly notifying the Director if any scars or marks present upon arrival and/or during that first diaper change.

Description: Based on observation and interviews, it was determined that the licensee did not ensure that all children wash their hands with soap and running water before and after eating meals and snacks. Evidence: 1. After child #2 (three years old) was observed having her diaper changed, she was observed playing with toys in the Preschool classroom without washing her hands. 2. Staff #4 confirmed that child #2 did not wash her hands after her diaper was changed.

Plan of Correction: The facility responded: Staff were trained on proper hand washing.

Complaint related: Yes
Description: Based on observation and interviews, it was determined that the licensee did not ensure that disposable diapers shall be disposed of in a leak-proof or plastic-lined storage system that is either foot-operated or used in such a way that neither the staff member's hand nor the soiled diaper touches the exterior surface of the storage system during disposal. Evidence: 1. Staff #4 was observed lifting the lid of the trash can with her hand to dispose of a soiled diaper in the Preschool classroom, even though it had a food-operated mechanism to open it. 2. Staff #4 confirmed that she disposed of the soiled diaper by lifting the lid of the trash can instead of using the hands free method (foot pedal) available.

Plan of Correction: The facility responded: Staff were trained on diapering and diaper disposal.

Complaint related: Yes
Description: Based on a review of documentation and interview, it was determined that the licensee did not ensure that the center shall notify the parent by the end of the day of any known minor injuries. Evidence: 1. When child #1's (four months old) diaper was changed at home on 7/30/19, his parents discovered an open wound on his upper thigh. 2. The Daily Care Report (Infants) shows that diapers changes were completed for child #1 at 8:15am, 10:31am, 11:53am and 2:18pm by staff #1 and staff #3. 3. Staff #3 stated that she did not notify parents, but did notify staff #5 (Program Director) about the open wound on child #1 and showed it to her after completing a diaper change for child #1 at 11:53am. 4. The parents of child #1 stated that they did not receive any notification from the center regarding their child's injury.

Plan of Correction: The facility responded: Child#1 arrived at the learning center the morning of 7/30/19 with the scar present. The Director contacted the family but received no answer. The Director will now email parents for documentation purposes if there is no answer when attempting to call about any situation at the facility.

Complaint related: Yes
Description: Based on a review of documentation and interview, it was determined that the licensee did not ensure that the center shall maintain a written record of children's serious and minor injuries in which entries are made the day of occurrence.

Evidence:
1. The parents of child #1 stated that no injury report was provided to them on 7/30/19.
2. All staff interviewed at the center confirmed that a written record of child #1's injury was not completed on 7/30/19.

Plan of Correction: The facility responded: Child#1 did not sustain any injuries at the facility. Child #1 arrived at the facility with t he markings present on his body. An incident report was completed at the facility and signed by the infant teacher and site director to document that an attempt was made to contact the family.

Standard #: 22VAC40-185-560-F
Complaint related: Yes
Description: Based on observation and interview, it was determined that the licensee did not ensure that when the center chooses to provide meals or snacks, a menu listing foods to be served for meals and snacks during the current one week period should be dated and children shall be served meals that meet USDA requirements. Evidence: 1. The menu posted for the current week listed grapes as one of the items being served for lunch today. However, the children in care today were not observed eating grapes for lunch. 2. Children were observed eating peanut butter and jelly sandwich, macaroni and cheese, and peas. There was no fruit or milk served to meet USDA requirements. 3. When the children in the School Age classroom were asked if they had milk or a fruit with their lunch, they said no.

Plan of Correction: The facility responded: Milk is served with every meal. When the inspector asked students about drinking milk, there answer reflected if they actually drunk the milk and not if milk was served. Many students do not drink the milk; however, they are served milk with every meal. The cook was informed to ensure all meals are meeting USDA requirements.
