Comments:
A complaint was received in the Division of Licensing Office on 9/5/19 related to ratio in the infant and toddler (mixed age) grouping in the morning time. A investigation was started on 9/6/19 at 7:30 am to observe the morning ratios in the identified room and staff who were working were interviewed. A follow-up inspection was made on 9/13/19 to review staff records and interview the director. The complaint inspection was completed on 9/18/19 and emailed to the provider on that date. There were violations of the Standards related to the complaint (ratio and supervision) and additional violations cited not related to the complaint.

Complaint related: Yes
Description: Based on record review and interviews, the center failed to ensure that one staff member who meets the qualifications of a program leader or program director was regularly present.

Evidence:
1. The records for staff #1 and #2 were reviewed. Staff #1 and #2 were the staff observed to be present with the children during the inspection on 9/6/19. Neither staff had the qualifications of education and training required for the program leader job position nor the experience required by the job position (six months of programmatic experience working with children).

2. Staff #1 and #2 were interviewed and were determined to be the only staff with the children from opening until 8:30 am in one grouping the entire week of 9/2/19-9/6/19.

3. Staff #3 verified that neither staff #1 nor staff #2 met the requirements for program leader.

Plan of Correction: A program lead qualified staff person will be in this grouping of children each day until staff #1 meets the requirements of the job position.

Description: Based on observation, record review of attendance/sign-in sheets and interviews, the center failed to ensure that when children are regularly in ongoing mixed age groups, the staff-to-children ratio applicable to the youngest child in the group applies to the entire group.

Evidence:
1. At approximately 7:35 am on 9/6/19 there was a group of nine (9) infants and toddlers in one room with two staff. The youngest child in the group was eight (8) months old and the oldest child in the group was 22 months old. Six of the children were between eight (8) months and 14 months; three children were 20 months, 21 months, and 22 months. Based on on the ages, three staff would be required to meet the ratio of one staff person for every four children. Infant age was the youngest in the group so that ratio would be required.

2. At approximately 8:01 am, there were 13 infants and toddlers from eight (8) months through 22 months with three staff. Based on the ages and number of children, four staff would be required to meet the required ratio of one staff person for every four children. Infant age was the youngest in the group so that ratio would be required.

3. As of 8:30 am, there were 15 children from eight (8) months through 22 months with three staff in the one room prior to the toddler children moving to their assigned room. Four staff would be required to meet the ratio of one staff for every four children. Infant age was the youngest in the group so that ratio would be required.

4. Staff #1 and #2 were asked about the daily process for arrival of children from 7:30 am until later morning. Both staff verified that this room was the room where infants and toddlers arrived until other staff arrived when the toddlers were moved to their classroom. This move would happen daily 8:30 am or after. The staff were specifically asked if this was a regular and ongoing practice and they stated that it was a daily practice each morning for as long as they had been employed (both four months).

5. Staff #3 verified that the arrival of infants and toddlers in one group in the early morning hours was the practice daily.

6. It was determined through interviews with staff and review of attendance records that the ratio in this regularly, ongoing mixed age group room was not met for the entire week on 9/2/19. Based on the information reviewed the following were the numbers of children and staff: on 9/3/19 @ 7:10 am nine (9) children eight months through 21 months with two staff (three staff required) @ 8:30 am 18 children from eight (8) months through 22 months with two staff (four staff required); on 9/4/19 @7:30 am 11 children from eight (8) months through 22 months with two staff (three staff required) @ 8:30 17 children from eight (8) months through 22 months with two staff ( five staff would be required); 9/5/19 @7:25 am 10 children from eight (8) months through 21 months with two staff (three staff required) @8:00 am 15 children from eight (8) months through 22 months with two staff (four staff required).

Plan of Correction: On Wed/Thur 2 staff called out and supervisor was trying to get substitutes in.

Complaint related: No
Description: Based on observation, the center failed to ensure that hand washing was practiced as required.

Evidence:
1. An 11 month old infant was observed being given a bottle to feed herself. The infant did not have her hands washed or staff did not use disposable wipes on the child's hands prior to her feeding herself.

Plan of Correction: Hand washing procedures have been reviewed with staff.

Complaint related: No
Description: Based on observation and interview, the center failed to ensure that heated formula was tested for temperature before serving to a child.

Evidence:
1. A bottle of approximately six ounces was observed being heated in hot water for several minutes. The bottle was shaken but not tested for temperature prior to being given to an 11 month old infant for feeding.

2. Staff #1 verified,when asked by the inspector, that the formula was not tested for temperature before being given to the infant.

Plan of Correction: Procedures were reviewed with staff.
