Technical assistance was provided in the following areas of the standards: 22VAC40-191 (Background checks); 22VAC40-185-(2)-60-A (Children's records); 22VAC40-185-(3)-190 (Program Director qualifications); 22VAC40-185-(4)-330 (Play areas); 22VAC40-185-(7)-530 (CPR/first aid certification); 22VAC40-185-(7)-550 (Emergency drills)

Comments:
An unannounced monitoring inspection was conducted on 9/19/19 from 8:45am - 10:15am. During the inspection there were 5 children ages one year old through three years old in care with three staff. Children were observed participating in various activities in the classrooms and eating morning snack. Records were reviewed for five children and five staff. There was no medication at the facility. Emergency procedures, and emergency supplies were reviewed during the inspection. Areas of non-compliance are identified on the violation notice and were discussed during the exit interview.

Violations:
Standard #: 22VAC40-185-160-C
Description: Based on a review of five staff records, it was determined that the facility did not ensure that at least every two years from the date of the first initial screening or testing, staff members shall obtain and submit the results of a follow-up tuberculosis screening.

Evidence:
1. The record for staff #5, contained documentation of TB screening that was dated 9/8/17.
2. Staff #6 (Program Director), reviewed the record for staff #5 and confirmed that an updated TB screening had not been received.

Standard #: 22VAC40-185-330-B
Description: Based on observation, it was determined that where playground equipment is provided, resilient surfacing shall comply with minimum safety standards when tested in accordance with the procedures described in the American Society for Testing and Materials standard F1292-99 and shall be under equipment with moving parts or climbing apparatus to create a fall zone free of hazardous obstacles.

Evidence:
1. There is a yellow stationary playground apparatus that looks like a car and rocks back and forth. There is less than six inches of resilient surfacing (sand) in the fall zone for this piece of equipment. There is grass growing in the sand.
2. Staff #1 (Program Director) confirmed that there was not six inches of resilient surfacing in the fall zone area for this equipment.

Standard #: 22VAC40-185-340-C
Description: Based on observation and interviews, it was determined that the facility did not ensure that during the stated hours of operation, there always shall be on the premises when one or more children are present one staff member who meets the qualifications of a program leader or program director and an immediately available staff member, volunteer or other employee who is at least 16 years of age, with direct means for communication between the two of them.

Evidence:
1. The Licensing Inspector arrived to the facility at 8:45am and observed staff #1 alone with four children ages two years old to three years old in the Preschool classroom.
2. When asked if there were any other staff present, staff #1 stated no because the staff #2 was on a bus run.

Standard #: 22VAC40-185-530-A
Description: Based on a observation, a review of documentation and interviews, it was determined that the licensee did not ensure that there is at least one staff member trained in first aid, cardiopulmonary resuscitation, and rescue breathing as appropriate to the age of the children in care who is on the premises during the center's hours of operation and also one person on field trips and wherever children are in care.

Evidence:
1. Staff #1 was working alone in the facility with four children when the Licensing Inspector arrived at 8:45am.
2. The record for staff #1 contained a CPR/first aid certification card that expired in June 2019.
3. Staff #1 and Staff #6 (Program Director) both confirmed that there was no staff present with a current CPR/first aid certification from approximately 7:45am till 8:50am while staff #2 was on a bus run.

Standard #: 22VAC40-185-580-C
Description: Based on observation, a review of documentation, and interview, it was determined that the licensee did not ensure that during the transportation of children a list of the children being transported is maintained in the vehicle.

Evidence:
1. When staff #2 arrived back at the center from transporting the children to the local public school she was asked if she had a list of the children she transported, and she stated no that she had left it at the center.
