Comments:
An investigation was initiated on 8/29/19 in response to a self reported incident on that same date regarding inappropriate behavior guidance by a staff person. An unannounced on-site inspection was conducted on 8/29/19. Interviews with staff were conducted and records and documentation related to the incident were reviewed. Additional staff interviews were conducted on 9/5/19 and 9/16/19 and written statements were obtained. The investigation was concluded on 9/16/19. Based on information gathered during the investigation, the incident is determined to be valid. One violation in the area of programs is cited on the violation notice and was discussed with the center owner on 9/19/19 during the exit interview.

Description: Based on interviews and written statements, it was determined the center did not ensure that behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.

Evidence:
1. The parent of child 1, age 15 months, stated when she arrived at the center the evening of 8/28/19 to pick up her child, she heard crying coming from her child's classroom. The parent stated when she arrived at the door to the classroom she saw her child and another child crying. She stated she witnessed staff 1 pick her child up and "shake" him. The parent stated staff 1 picked her child up from under his arms, held him at eye level and "shook" him in a "quick" motion back and forth one time. The parent stated she also heard staff 1 yell "What? What do you need?" at her child as she was picking him up. The parent stated staff 1's tone was "aggressive" and loud.
2. Staff 2 stated she was in the kitchen at the end of the day on 8/28/19 and could hear crying coming from a classroom. Staff 2 stated she went to see what was going on and could hear staff 1 stating to a child "What? What do you need me to do?" Staff 2 stated she could "sense frustration" in staff 1's tone and that staff 1 was speaking at a higher volume than normal. Staff 2 stated she spoke with staff 1 about the tone of her voice and how it was unacceptable.

Plan of Correction: The center responded with the following: "Upon receiving the information regarding the incident that occurred on 8/28/19 the staff member in question was immediately reprimanded for her actions by our evening manager. The following day there was a meeting held with the owner, the child's parent, the staff member in question as well as the program director. Following that meeting and based on the additional information provided by the parent, the staff member in question was immediately terminated. There was a staff meeting held to reiterate what is expected of each teacher during their workday as well as reminded them of procedures that are in place to prevent frustration. Those procedures are as follows: Maintaining lower ratios in each classroom; each staff member is provided an hour-long lunch break daily; walky-talkies are disseminated each morning to each classroom so that teachers can easily call for assistance when needed; we created the position of the Program Director in addition to Administrative Director to offer assistance and to provide classroom support as needed throughout the day such as giving the teachers a quick break for regrouping, restroom breaks, being an extra set of hands, offering ideas on behavior management, etc; all staff is instructed upon hire and also trained at monthly staff meetings the proper procedures to manage frustration in the classroom and tools to use in the event that this occurs."
