Comments:
An investigation was initiated on 8/21/19 in response to a complaint received by the Eastern Regional Office that same day regarding concerns about the outdoor play area. An unannounced on-site inspection was conducted on 9/20/19. Interviews with staff were conducted and the outdoor play area was inspected. Based on information gathered during the investigation, the complaint is determined to be valid. One violation in the area of physical plant is identified on the violation notice and was discussed with the center owner during the exit interview.

Description: Based on measurement it was determined the center did not ensure that where playground equipment is provided, resilient surfacing shall comply with minimum safety standards when tested in accordance with the procedures described in the American Society for Testing and Materials standard F1292-99.

Evidence:
1. There is only 2 inches of mulch in the fall zones of the play structure on the playground, where 6 inches is required. Additionally, there is grass and weeds growing up through the resilient surface within the fall and use zones of the play structure. Grass and weeds growing in the resilient surface negates the resiliency of the surface.
2. Staff 1 confirmed that there is less than 6 inches of resilient surfacing on the playground and that grass and weeds were growing up through the mulch.

Plan of Correction: The center responded with the following: Contact Tidewater Mulch and order new mulch
