Comments:
An unannounced inspection was conducted on July 24, 2019, July 31, 2019, and August 19, 2019 regarding a self-reported incident received in the Valley Licensing Office on July 22, 2019. The on-site portion of the inspection was held on July 24, 2019 from 12:05 p.m. to 2:15 p.m. At that time, there were 83 children present and in the care of 15 staff members with three extra staff members available to assist when needed. There were 124 children enrolled in the center. Six staff members were interviewed and one child's record was reviewed. The violations resulting from the inspection were noted on the violation notice and the risk ratings for the violations were listed on the supplemental page.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on review of the center?s Movement Log Policy, the roll call sheet, the classroom movement log, and confirmation from staff interviews, the center failed to ensure their operational responsibilities were met by not following their own supervision policy when a child was left alone in the bathroom of the classroom.

Evidence:
1. The center?s Movement Log Policy states, ?Each time a movement is being done, a final sweep of the room will be conducted to ensure all children are accounted for and no one is left behind.?
2. On July 22, 2019, Child A (age 4 years) in Classroom A was left alone in the bathroom of the classroom when Staff #1, Staff #2, and Manager, Staff #3, took the rest of the children outside to the playground. Child A was found in the Classroom A by Staff #4 approximately 30 seconds to two minutes after the group had left the room. Staff #4 took Child A to the playground to join the group. Staff #1, Staff #2, and Staff #3 were not aware the child had been left.
3. The roll call sheet for July 22, 2019 listed 15 children present in Classroom A. Staff #1 stated there were 15 children present and 15 children listed in the tablet roster for the day.
4. Staff #3 stated she was called down to Classroom A for a manager?s sign-out. Staff #3 reported that when she entered the room she was told by staff there were 14 children present. Staff #3 counted 14 children and signed off on the log. After the children entered the hallway, Staff #3 stated she checked the classroom and did not see any children, but she did not check the bathroom.
6. The center?s policy was not followed when a final sweep of the entire classroom was not completed to ensure no child was left behind.

Plan of Correction: Immediately after the incident staff was retrained on COA policies regarding supervision. Before leaving any location, staff will always check the area, including bathrooms, behind furniture, doors, and learning equipment for children.

Standard #: 22VAC40-185-340-A
Description: Based on interviews with six staff members, review of the roll call sheet, review of the classroom movement log, and confirmation from staff, the center failed to ensure the care and protection of a child when one child was left alone in the classroom.

Evidence:
1. On July 22, 2019, Staff#1 and Staff #2 were supervising 15 children in Classroom A when they started to line-up at the door to go to the playground. Staff #1 stated that he saw Child A (age 4 years) come out of the bathroom and get in line with the rest of the children, but he did not see Child A leave the line and go back into the bathroom. Staff #1, Staff #2, and Staff #3 walked 14 children out of the classroom, into the hallway and out the door to the playground. Approximately 30 seconds to two minutes later, Staff #4 walked into Classroom A and found Child A by the sink in the back of the room. Staff #4 walked Child A to the playground. Staff #1 and Staff #2 were not aware that Child A was missing from the group.
2. The roll call sheet for July 22, 2019 listed 15 children present in Classroom A. Staff #1 reported he knew there were 15 children present and that 15 children were logged into the tablet as being present. Staff #1 reported that he thought Staff #2 and Staff #3 had done the counting and the sign-out before they left for the playground. He stated, ?I did not count heads before we filed out. I should have.? Staff #1 reported that too many different teachers were in and out of the classroom that morning.
3. Staff #2 stated that she had just entered Classroom A a couple of minutes before leaving to go outside. Staff #1 and Staff #2 did not communicate with one another about how many children were present in the classroom. Staff #2 did not look on the roll call sheet or in the tablet to see how many children were signed in for the day. Staff #2 counted 14 children present and entered that number on the movement log. She reported she did not see Child A in the classroom.
4. Staff #3 reported that she entered Classroom A to do a manager?s sign-out and she was told by staff there were 14 children present. She counted 14 children, signed off on the movement log, and the class proceeded to leave the classroom. Staff #3 did not verify that the reported number of children present in the classroom was accurate. Staff #3 stated that after the children were in the hallway, she checked the classroom and did not see any children but she did not check the bathroom.

Plan of Correction: Immediately following the incident staff was retrained on licensing standards and COA policies on movement and supervision of children. Staff will always ensure care, protection, and guidance of the children in our care.

Standard #: 22VAC40-185-340-F
Description: Based on interviews with six staff members and verification from staff, the center failed to ensure that a child under the age of 10 was in actual sight and sound supervision of staff.

Evidence:
1. Staff #1 and Staff #2 were supervising 15 children in Classroom A on July 22, 2019. Child A (age 4 years) was in the bathroom and not in sight and sound supervision of staff when Staff #1, Staff #2 and Staff #3 left the room with 14 children and walked to the playground without Child A. Staff #4 entered Classroom A and found Child A approximately 30 seconds to 2 minutes after the staff and children had left the room for the playground.
2. Staff #1 reported that it was no more than 30 seconds to one minute after the group had arrived on the playground when Staff #4 came to the door of the playground with Child A.
3. Staff #2 stated that after about a minute of being outside, Staff #4 came to the door of the playground with Child A.
4. Staff #4 stated that she thought it was one or two minutes that Child A was left alone.

Plan of Correction: Immediately following the incident staff was retrained on licensing standards and COA policies for sight and sound supervision of the children. Children will always be kept within sight and sound.
