63.2(17) License & Registration Procedures

Technical Assistance:
Discussed resilient surfacing requirements for playground equipment. A minimum of six inches of resilient surfacing is required. Keep an eye on the wear on the smaller slide on the younger playground, if it becomes cracked it can become a scratching hazard.

Discussed requirements for fingerprint background checks and out of state central registry background checks.

Comments:
An unannounced monitoring inspection was conducted beginning at 9:30 a.m. to 12:00 p.m. with the extended day director. There were 52 children in care ranging in age from two years to five years of age under the care and supervision of 10 staff. Two year olds were observed during morning circle time. Preschoolers were observed during transition time to music or sports, during story time and morning snack. Food is brought from home.The small playground was inspected during the inspection.

Five children's records and four staff records were reviewed.

Violations:
Standard #: 22VAC40-185-330-B
Description: Based on observation of the small playground and measurements, it was determined that the center did not maintain the required amount of resilient surfacing for all playground equipment. Evidence: During the inspection, the Licensing Inspector (LI) measured wood mulch in fall zones and use zone areas of the playground equipment.
1. Wood mulch measured 2 inches in depth in front of the chute of Slide #1.
2. Wood mulch measured 2.5 inches in depth on the left of Slide #1.
3. Wood mulch measured 3 inches in depth on the right side of Slide #2.
4. Wood mulch measured 3 inches in front of the chute of Slide #2.

Plan of Correction: Maintenance was contacted during the inspection and mulch will be added.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on review of staff files, it was determined that the center did not obtain national fingerprint background checks prior to the first day of employment for all staff. Evidence: Staff #1, date of hire 9/3/2019, fingerprint background check was dated 9/9/2019.

Plan of Correction: In the future all staff will have fingerprint results on file before hire.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on review of staff records, the center did not request and follow up on out of state central registry background checks for all staff that resided outside of Virginia in the past five years as required. Evidence: Staff #2 indicated residence in Texas on a sworn statement dated 8/28/2017. A request for an out of state central registry check was completed on 9/15/2017. There was no documentation that the center followed up with Texas regarding the status of the central registry check by the 45th day of the request.

Plan of Correction: Follow up with Texas will be conducted and documented immediately.
