Technical Assistance:
Technical assistance was provided in the following areas of the standards: 22VAC40-191 (Background checks); 22VAC40-185-(2)-60-A (Children's records); 22VAC40-185-(2)-70-A (Staff records); 22VAC40-185-(7)-510 (Medication)

Comments:
An unannounced monitoring inspection was conducted on 10/22/19 from 11:25am - 1:00pm. During the inspection there were 44 children ages three years old through five years old in care with eight staff. Children were observed participating in various activities in the classrooms, eating lunch, and during rest period. During the inspection the records for five children were reviewed at the center. The records for five staff were reviewed at the central office on 10/22/19. Medication, emergency procedures, and emergency supplies were reviewed during the inspection. Areas of non-compliance are identified on the violation notice and were discussed during the exit interview.

Violations:
Standard #: 22VAC40-185-140-A
Description: Based on a review of five children's records, it was determined that the licensee did not ensure that each child in attendance had a completed physical within one month of attendance.

Evidence:
1. The record for child #2, present during inspection, did not contain a physical examination.
2. Administrative staff confirmed that the record for child #2 did not contain a physical examination, and that child #2 had been enrolled for more than 30 days.

Plan of Correction: The facility responded: The parents of child #2 were called during the inspection and asked to provide a copy of the most recent physical examination. All newly enrolled children will have a physical examination in their record within 30 days of enrollment.

Standard #: 22VAC40-185-540-A
Description: Based on a review of the center's first aid kits, it was determined that the licensee did not ensure that all first kits contain all of the required items.

Evidence:
1. The first aid kit for the bus used for transporting the children to and from the center on a daily basis did not include a adhesive tape and an ice pack.
2. Administrative staff confirmed that the first aid kit on the center's bus did not contain all of the required first aid supplies.

Plan of Correction: The facility responded: The missing first aid supplies will be added to the first aid kit on the bus. We will check the first aid kit on regular basis to ensure it always has all of the required items.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on a review of five staff records, it was determined that the facility did not ensure that an employee is allowed to begin employment without a completed national criminal history record check (finger printing).

Evidence:
1. The record for staff #3 (date of hire 8/27/18), working during the inspection, did not contain documentation of a completed national criminal history record check (finger printing).
2. Administrative staff reviewed the record for the staff #3 and confirmed that she had not received the results of the finger print background check (finger printing).

Plan of Correction: The facility responded: Staff #3 will complete a national criminal record check. All new employees will have a completed national criminal record check completed prior to employment.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on a review of five staff records, it was determined that the facility did not deny continued employment of a staff who did not have a search of the central registry finding within 30 days of employment from any other state in which the employee has resided in the preceding five years.

Evidence:
1. The record for staff #1 (date of hire 10/1/94) did not contain documentation of a completed search of the central registry finding from the state of Maryland.
2. The record for staff #4 (date of hire 8/27/18) did not contain documentation of a completed search of the central registry finding from the state of Maryland.
3. Administrative staff review the records for the staff #1 and staff #4, and confirmed that the search of the central registry finding from the state of Maryland had not been received.

Plan of Correction: The facility responded: Staff #1 and staff #4 will complete a search of the central registry finding from the state of Maryland. All new employees who have lived in another state within the last five years will complete a search of the central registry finding from that state.
