Comments:
An unannounced monitoring inspection was conducted on 6/12/19 and 7/3/19 in response to a self-reported incident regarding a child's injury that occurred on 5/6/19. Based on record review, staff and classroom interviews, review of written policy, review of injury report, and observation of the playground, violations are noted on the Violation Notice. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on record review and staff interview, the center failed to ensure that the operational responsibilities of the licensee shall include, but not be limited to, ensuring that the center's activities and services are maintained in compliance with the center's own policies and procedures that are required by these standards.
Evidence:
1. Child A (4 years old), sustained a serious injury to her chin when she fell off of the Geometric Dome Climber on the playground and cut her chin on a zebra ride-on toy that was located in the fall zone. On the accident report sent on 6/14/19, it stated that the treatment given was "we wiped her with wipes. We made her calm and called her parents."
2. The Employee Handbook states that "If there is an emergency that requires immediate medical attention, staff members will call 911 and the school to get help from the supervisor or director present."
3. Staff A said "Child A was bleeding heavily around the chin/neck area", Staff B said ?She had a big cut?, Staff C said ?She had a little cut on the bottom of her chin?, Staff D said ?the wound seemed deep and she needed urgent care."
4. The licensee did not call 911 to seek immediate medical care for child A who sustained a serious injury.

Plan of Correction: We will clarify in our policy book on what emergencies require a 911 call. For example, if a child has a life threatening emergency, we will call 911. In the case of this incident, yes the child needed medical treatment and it was urgent, but not life threatening. She was able to sit, talk, no bleeding and coherent. We will use this distinction in our policy book so it is clear to everyone.

Standard #: 22VAC40-185-340-A
Description: Based on staff interviews, staff did not always ensure care and protection of children.
Evidence:
1. Staff did not intervene when children were using the flat surface of the zebra ride-on toy as a stepping aid for children to climb up onto the Geometric Dome Climber.
2. Staff did not intervene when Child A stepped on the zebra ride-on toy to be able to reach the first bar on the Geometric Dome Climber. As Child A continued to climb and reach for the next bar, she lost her balance, fell, and hit the zebra ride-on toy.
3. Staff A said "sometimes the children use the toy to climb up on the monkey bars.?

Plan of Correction: We have addressed this with all of our staff members in training and will not have any toys in the fall zone or the play ground in the future. The toy in question was used by the toddler class and the toddler teachers have been given alternative toys for their students.

Standard #: 22VAC40-185-550-M
Description: Based upon record review and staff interview, the center staff did not maintain a written record of children's serious and minor injuries in which entries are made the day of occurrence.
Evidence:
1. On 6/12/19, staff E stated the accident/incident report had not been maintained on-site for the incident that occurred on 5/6/19.
2. Staff E stated the information was listed on the ?Daily Health Observations? but was missing the time of injury, type and circumstance of the injury, staff present, treatment, date parents notified, time parents notified, method of notification to parents, and future action to prevent recurrence of the injury.

Plan of Correction: Not keeping the records was an unfortunate situation that resulted from us letting the parent of the child in question take the only copy we had. We gave the parent the form, because he did not get the chance to sign it on the day of the incident and we wanted him to review it, sign and get a copy. Instead, the parents took it and said he will review it and return it but he did not return it timely. In the future, we will prevent this by giving the parent a copy of the incident report instead of the only copy.
