63.2(17) License & Registration Procedures

Technical Assistance:
Discussed diaper changing pad and proof of education.

Due to the background check related violations cited in today?s inspection, the provider is required to follow-up with the appropriate department regarding the status of any missing and/or incomplete background checks. Documentation of the completed follow-up must be sent to the Licensing Inspector within 10 business days, and a copy of all missing/incomplete background check results must be sent to the Licensing Inspector upon arrival.

Comments:
An unannounced, non-mandated focused inspection was conducted today from 12:00pm-2:30pm. There were 21 children (2-5yrs.) supervised by 4 direct care staff. The physical plant and 4 staff records. Children were observed eating lunch and napping. Lunch served was rice, beans, mixed vegetables, and milk. There was a sufficient amount of books, toys, and materials, which were found to be developmentally appropriate for the children in care at the time of inspection. Areas of non-compliance are identified in the Violation Notice.

Violations:
Standard #: 22VAC40-185-160-A
Description: Based on a review of staff records, 1 of 4 staff records did not contain documentation of a negative tuberculosis screening.

Evidence: Staff C's (date of hire: 8/19/2019) TB evaluation certificated was dated 10/21/2019 and indicated a positive TB blood test.

Plan of Correction: The employee will be receiving results today.

Standard #: 22VAC40-185-280-B
Description: Based on classroom observation, the center did not ensure that hazardous substances were kept in a locked place using a safe locking method that prevents access by children.

Evidence:
1. In the Pre-Kindergarten classroom (children ages 4-5years old) and the 2 year-old classroom (children ages 2-3 years old), two spray bottles containing chemical cleaning solutions were found in unlocked teacher cabinets.
2. In the children's bathroom, two spray bottles containing chemical cleaning solutions were found in an unlocked cabinet under the sink.

Plan of Correction: We will move the bathroom spray bottles to a locked location, and reinforce the requirement for cleaning solutions to be locked up with staff.

Standard #: 22VAC40-191-60-C-2
Description: Based on a review of staff records, 1 of 4 staff records did not contain documentation of a central registry finding within 30 days of employment.

Evidence: Staff C's (date of hire: 8/19/2019) record did not contain documentation of central registry findings. The earliest documentation of agency follow-up was dated 10/7/2019.

Plan of Correction: Moving forward, we will be sure to make copies of background checks before they are mailed out, record the dates that they are mailed out, and keep documentation of all follow-up and communication until results are received.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on a review of staff records, 1 of 4 staff records did not contain documentation of fingerprint results.

Evidence: Staff A's (date of hire: 10/18/2019) record did not contain documentation of completed fingerprint results.

Plan of Correction: Effective today, we will no longer allow applicants to be hired or begin orientation until fingerprint results are obtained. There will be no exceptions.
