Comments:
An unannounced monitoring inspection was initiated on September 26, 2019 and completed on November 12, 2019 in regards to a self reported incident involving supervision. Areas of non-compliance are identified on the Violation Notice. Results of this inspection will be reviewed with the Licensing Administrator.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on documentation and interviews, it was determined the facility did not follow their own policy regarding child supervision.

Evidence: A review of the facility's policy under Staff Expectations and Supervision of Children state "Perform regular head counts & safety checks throughout the program's hours of operation. Count before & after moving a group." and "Never leave a child alone or alone with another adult or counselor." On September 18, 2019 staff did not follow the facility's own policy for supervising children as child #1 was left alone in the restroom when staff #1 returned to the classroom. Child #1 was not supervised by a staff member for approximately 3 - 5 minutes.

Plan of Correction: This violation and the actions of staff #1 are in direct violation of Newport News Parks, Recreation and Tourism Youth Program policies. Our program places a high value on protection of the children in our care. When these allegations came to the attention of our program administration, we immediately reported to VDSS for investigation of the actions of the staff members. All staff will receive disciplinary action. Further procedures were added to our bathroom practices to ensure added safety for all. Staff #1 has resigned effective 11/29/19.

Standard #: 22VAC40-185-340-A
Description: Based on documentation and interviews, facility did not ensure the care, protection and guidance of a child in care.

Evidence: On September 18, 2019, staff #1 took 4 children to the community center hall restroom. Staff #1 went into the boy's restroom with 3 of the children as a community member needed to the use that restroom as well. Staff #1 returned to the classroom with 3 children. Staff #2 told staff #1 that he did not have all of his children. Staff #1 disagreed. Staff #3 also stated that a child was missing. Child #1 was then brought to the classroom by a parent. Child #1 was not within actual sight and sound supervision for approximately 3 - 5 minutes. The community center hall restroom is utilized by all patrons of the community center who may use meeting rooms, gymnasium, pool and exercise room. Facility staff were not able to ensure the child's safety during the period when the child was not supervised.

Plan of Correction: Youth Programs will continue to enforce our written policies and hold our staff accountable for following them. Policies will continue to be reviewed with all staff including the implementation of additional bathroom practices. Immediately after reviewing and reporting the incident, new procedures were implemented to ensure proper supervision. Staff members are in the disciplinary process.

Standard #: 22VAC40-185-340-F
Description: Based on documentation and interviews, facility did not ensure that children under 10 years of age shall always be within actual sight and sound supervision of staff, except that staff need only be to hear a child who is using the restroom.

Evidence: Interviews with staff and review of facility documentation indicated child #1 (3 years old) was not within actual sight and sound supervision of a staff member on September 18, 2019 for approximately 3 - 5 minutes when the child was discovered by a parent alone in the restroom.

Plan of Correction: Immediately after reviewing the incident, new procedures were implemented to ensure proper supervision. Staff members are in the disciplinary process.
