Comments:
An unannounced monitoring inspection was conducted on Wednesday, November 13, 2019 to determine the center's compliance with licensing standards that could not be determined during the initial inspection. The inspector arrived at the center at 2:20pm and concluded the inspection at approximately 5:45pm. The center's director and owner assisted the inspector throughout the inspection. The census for today's inspection consisted of 131 children in the direct care of 18 staff members. Additional administrative staff were available at the center. Upon the inspector's arrival, the preschool children were resting in their designated classrooms. The children were later observed engaged in a variety of activities to include taking bathroom breaks, eating snack, playing with toys, interacting with peers and staff. The staff were observed having positive interactions with the children.

Ten children's records, three medication authorizations, fourteen staff's background checks, and ten staff records were reviewed. The violations cited in the previous inspection were checked for corrections. There were no repeat violations during today's inspection.

Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from the day of receipt. You should specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Violations:
Standard #: 22VAC40-191-60-B
Description: Based on review of 24 staff's background checks on 11/13/2019, one staff did not complete a sworn statement prior to the beginning of employment.

Evidence: The sworn disclosure statement for Staff #17, hired on 9/23/2019, was dated 10/18/2019. An employee or volunteer of a licensed or registered child welfare agency or of a family day home approved by a family day system must not be employed or provide volunteer service until the agency or home has the person's completed sworn statement or affirmation.

Plan of Correction: Per the Center: "The school recently changed ownership. As part of the overall onboarding process of the entire team, Staff #17 completed a paper sworn disclosure prior to the date of hire, however this original document was misplaced. When the administrative team discovered the missing paperwork in their routine file audit, they immediately had the employee fill out another copy for the file. The paperwork should have been dated to the original date it was completed and signed, which was prior to the date of hire. Site administration will continue the system of file audits for full compliance, which is what caught this error initially."

Description: Based on review of 24 staff's background checks on 11/13/2019, the center did not request, within 30 days of hire, a search of out-of-state founded complaints of child abuse for two staff members who have lived outside of Virginia within the last five years.

Evidence: 1) The sworn statement for Staff #7, hired on 9/23/2019, indicated the staff member had lived outside of Virginia within the last five years. The records did not contain documentation of a requested founded complaint of child abuse from the state the staff member indicated she had lived in within the last five years.

2) The sworn statement for Staff #8, hired on 9/23/2019, indicated the staff member had lived outside of Virginia within the last five years. The records did not contain documentation of a requested founded complaint of child abuse from the state the staff member indicated she had lived in within the last five years.

Plan of Correction: Per the Center: "The school recently changed ownership. There was a misunderstanding that previously obtained, out of state child protective services checks would transfer from previous ownership to new ownership. We were counseled that certain documents were able to transfer from previous ownership to new ownership, and it was a misunderstanding that out of state child protective services checks had to be completed again even if the staff member had not returned to the previous state as a resident. Upon direction from the department of social services, the requests were reissued on 11.14.2019 for staff member # 7 and 11.13.2019 for staff member #8. All background check requirements have been reviewed and the HR coordinator will work with Site Administration for continued compliance to this standard."
