Comments:
An unannounced monitoring inspection was initiated off site on October 24, 2019 in response to a self reported incident that occurred on October 23, 2019. Interviews were conducted on the phone and at the facility. The inspection concluded on November 14, 2019.
Based on staff interviews and documentation reviewed, the self reported incident regarding transportation and supervision of children resulted in violations.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on interviews with staff and review of transportation policies, the facility failed to follow the center's own policies and procedures that are required by these standards. Evidence: center's vehicle safety rules state "Children shall never be left unattended on the bus." and that drivers "be responsible for final check to assure all children have vacated the bus." On October 23, 2019, Staff 1 did not follow the center policies for transportation when Child A (age 5) was left unattended on the bus. Staff 1 stated that she did not complete a walk through of the bus to verify that all children had been removed from the vehicle.

Plan of Correction: Staff 1 has been terminated and all other drivers have been retrained on transportation policies and procedures.

Standard #: 22VAC40-185-340-A
Description: Based on staff interviews, the facility failed to ensure that when staff are supervising children, they always ensure their care, protection, and guidance. Evidence: On October 23, 2019, Staff 1 transported a group of children from the elementary school to the center in Bus 1, arriving at approximately 4:05 p.m. At approximately 4:17 p.m., Staff 2 arrived at the center with another group of children in Bus 2. As Staff 2 was parking, she saw Child A, age 5, standing at the front of Bus 1 by the driver's seat, alone, and crying. Staff 2 went into the center to get the keys to unlock Bus 1 for Child A. She saw Staff 1 as she was leaving for the day; Staff 1 did not know Child A was left on the bus.

Plan of Correction: Staff 1 has been terminated and all other drivers have been retrained on transportation policies and procedures.

Standard #: 22VAC40-185-340-F
Description: Based on staff interviews, the facility failed to have all children under 10 years of age within actual sight and sound supervision. Evidence: on October 23, 2019, Staff 1 left child A, age 5, alone on the bus parked in the center parking lot for approximately 12 minutes. Staff failed to ensure the Child A was in sight and sound supervision from approximately 4:05 p.m. to 4:17 p.m., when Staff 2 found Child A alone on the bus.

Plan of Correction: Staff 1 has been terminated and all other drivers have been retrained on transportation policies and procedures.

Standard #: 22VAC40-185-580-K
Description: Based on staff interviews, the facility failed to have staff verify that all children have been removed from the vehicle at the conclusion of any trip. Evidence: Staff 1 arrived at the center on October 23, 2019 with a group of children. Staff 1 did not ensure the vehicle was empty as Child A, age 5, was left alone on the bus for approximately 12 minutes. Staff 1 stated that she did not complete a walk through of the bus to verify that all children had been removed from the vehicle.

Plan of Correction: Staff 1 has been terminated and all other drivers have been retrained on transportation policies and procedures.
