Comments:
An unannounced complaint inspection was conducted on this date from approximately 1:30 pm to 3:40 pm. The complaint was related to allegations that two staff used inappropriate behavioral guidance with children in care. During this visit, interviews with staff and administration were conducted, staff files were reviewed and classrooms were observed. The information gathered during this investigation supported the allegations, so the complaint was determined to be valid. Violations not related to the complaint were also cited. Areas of non-compliance are listed in the Violation Notice. Please complete the columns for "Plan of Correction" and "Date to be Corrected" for each violation cited on the violation notice, and then return a signed and dated copy to the licensing office within 5 business days of receipt. Complaint related: No
Description: Based on observation, hazardous substances were not kept in a locked place using a safe locking method that prevents access by children.
Evidence:
1) In the Baby Ducklings room, cleaning agents were observed in a cabinet that was unlocked. Although the cabinet had a locking mechanism, it was not locking properly.
2) In the Baby Ducklings room, a container of disinfecting wipes was observed resting on a counter top.

Plan of Correction: Items were removed. Reminded staff about locking materials up properly.

Complaint related: Yes
Description: Based on interviews with staff, it was determined that behavioral guidance provided by staff was not constructive in nature, age and stage appropriate, and was not intended to redirect children to appropriate behavior and resolve conflicts.
Evidence:
1) Staff 4 stated that on October 18, 2019, Child 1 [20 months] was displaying negative behavior. Staff 4 reported that she witnessed Staff 1 and Staff 2 shaking a stuffed teddy bear in front of Child 1's face. Child 1 started screaming and crying. It was overheard by Staff 4 that Staff 1 and Staff 2 told Child 1 that they would bring the teddy bear back if he kept displaying negative behaviors. Staff 4 asked them to stop.
2) Staff 4 stated that on October 29, 2019, she witnessed when Staff 2 threw a ball made out of a soft material at the back of Child 2 (20 months). Staff 4 reported that the child was not listening and Staff 2 seemed frustrated by it. Child 2 felt when the ball hit him but did not cry.

Plan of Correction: Involved Staff 1 and Staff 2 were no longer employed by the center as of Friday, November 1, 2019.

Description: Based on interviews with staff, it was determined that children staff used a forbidden action of enclosing children in a small confined space where the child could not freely exit himself.
Evidence:
1) Staff 4 reported that on October 25, 2019, she witnessed Staff 1 and Staff 2 putting children inside the ball cage in the outdoor area and verbally stating that it was as punishment for going to the grassy area when they were told not to. Staff 4 reported that children looked sad but were not crying.
2) Staff 5 stated that from the classroom window next to the outdoor area, witnessed a child inside the ball cart. Staff 5 opened the door to the outdoor area to find out what was happening and saw that Staff 2 was outside with the children.
3) It is unknown how long the children were in the ball cage.

Plan of Correction: Involved Staff 1 and Staff 2 were no longer employed by the center as of Friday, November 1, 2019.
