2/7/2020 - The violation notice was amended as a result of a first step review.

An unannounced complaint investigation was conducted with two local agency representatives regarding injuries sustained by a child while in care. Time of inspections: November 21, 2019 from 9:00 a.m. to 10:30 a.m. and November 22, 2019 from 9:00 a.m. to 10:00 a.m. Additional documentation was received on December 11, 2019. Based on staff interviews and documentation reviewed, the preponderance of evidence gathered during the investigation supports the allegations. The complaint is determined to be valid. Standard #: 22VAC40-185-40-E
Complaint related: Yes
Description: Based on interviews with staff and review of discipline policies, the facility failed to follow the center's own policies and procedures that are required by these standards. Evidence: 1. The discipline and behavior policy states "Do model appropriate behavior for the children. Do provide alternative for inappropriate behavior to the children. Do use short supervised periods of time out. Do stay consistent in our behavior management." 2. On November 11, 2019, Staff 1 reported that Child A (age 2) "was hitting her and pulling her hair" on the playground. Staff 1 put her in time out and "she held both of the child's coat sleeves with one hand and blocked the hits with the other hand." Staff 2 stated she saw Child A "hitting Staff 1", and saw "Staff 1 held the child by her sleeves, then by her wrists and then by her upper arm." "Child A still did not calm down and Staff 1 walked away."

Plan of Correction: Clover Hill has implemented a detailed Aggressive Behavior Management policy. All Aggressive Behavior Management policy forms have been signed by the staff.

Complaint related: Yes
Description: Based on review of photographs and staff interviews, the facility failed to ensure that when staff are supervising children, they always ensure their care, protection, and guidance. Evidence:
1. On November 11, 2019 at pick up time, Staff 1 told the parent that Child A (age 2) had a rough day. She stated "the child was pulling her hair and hitting her." 2. The parent observed redness and bruising on the child's hands and took the child to the police station where photos were taken. The photos show bruising on the inside of the wrist and redness on the back of both hands. Both the parent and Staff 1 stated that no injuries were observed on Child A at drop off on the morning of November 11, 2019.
3. Staff 1 stated that "she put the child in time out on the playground and the child was throwing herself around". Staff 1 stated she "held her coat sleeves to prevent her from hitting".
4. Staff 2 stated she saw Staff 1 "hold Child A's arms by her sleeve, then by her wrists, and then by her upper arms."

Plan of Correction: The present staff has been trained on the new Aggressive Behavior Management policy. New staff will be trained on this policy during the hiring process.

Complaint related: Yes
Description: Based on staff interviews, the facility failed to provide behavioral guidance that was constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior and resolve conflicts. Evidence: Staff 1 stated that on November 11, 2019 Child A (age 2) was "having a rough day, hitting and pulling hair" and "she put the child in time out on the playground." Staff 1 stated that Child A was "throwing herself around" and "she held her arms by her coat sleeves to prevent her from hitting". Staff 2 stated she saw Staff 1 "hold Child A's arms by her sleeve, then by her wrists, and then by her upper arms." Child A did not calm down, so Staff 1 walked away.

Plan of Correction: The present staff has been trained on the new Aggressive Behavior Management policy. New staff will be trained on this policy during the hiring process.
