Comments:
The licensing inspector conducted an unannounced inspection in response to a complaint that was received by the department on October 8, 2019 regarding ratios, supervision, and the physical plant. The investigation was initiated on November 6, 2019 and completed on December 30, 2019. On November 6, 2019, the licensing inspector conducted an unannounced inspection from 8:10am to approximately 9:00am. Interviews were completed, observations were made in the center, and documentation was reviewed. On December 11, 2019, the inspector conducted additional interviews. The preponderance of the evidence gathered during the investigation supports the allegation regarding ratios and supervision, therefore the complaint is determined to be valid. Standard #: 22VAC40-185-340-A
Complaint related: Yes
Description: Based on observation and interviews on 11/06/2019, the center did not ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance.

Evidence: On 11/06/2019 at 8:10am, the licensing inspector observed the following:

1) When the inspector arrived at the center, the outside door that enters into the two?s classroom was propped open with a plastic block. 2) The inspector was informed that the door is usually propped open to allow parents easy access to the center during drop off until 9am. 3) This door when opened could allow the children access to the busy parking lot in front of the center and the four lane road approximately 140ft from the center, with a speed limit of 45 MPH.

4) Upon entering the building, the licensing inspector observed seven, two-year-old, children alone and unsupervised in the two?s classroom. Approximately two minutes after the inspector arrived, Staff #2 greeted the inspector and reported the two?s teacher, Staff #1, stepped out of the building to walk a child to the bus stop.

5) Staff #1 did not return to the building for approximately seven minutes after the inspector arrived. During this time, the children were observed running around near the door and in the classroom without direct guidance from staff.

Plan of Correction: Per the Center: "We no longer allow the door to be propped at all if children are in the room. We moved the opening room to the toddler room to ensure the children are not near the main entrance during busy drop off times in the mornings. The children are separated into their assigned classrooms by 8am and the door is not propped. It remains locked the remainder of the day and a doorbell must be rung for entry to the center."

Description: Based on observation and interviews on 11/06/2019, the center did not ensure that children under 10 years of age always shall be within actual sight and sound supervision of staff.

Evidence: 1) The licensing inspector arrived at the center at 8:10am and observed Staff #1 leaving the premises with a child. Upon entering the building, the licensing inspector observed seven children alone and unsupervised in the two's classroom.

2) At 8:10am, Staff #2 was observed inside the three's classroom talking to the children in her care. At approximately 8:12am, Staff #2 turned around and walked to the door that separates the two's and the three's classroom. Staff #2 reported she was to be standing in between the classrooms while Staff #1 walked a child to the bus stop. However, Staff #2 did not have actual sight and sound supervision of the seven children in the two's classroom.

3) The licensing inspector observed Staff #1 returning to the building approximately five to seven minutes later.

Plan of Correction: Per the Center: "Staff one was written up and is now not even employed at the center anymore. Also, all children who ride buses have been transferred to our other center to prevent teachers from having to place children on the bus at this center. Staff 2 said staff 1 left before another teacher arrived against Staff 2's advisement."

Complaint related: Yes
Description: Based on observations and interviews on 11/06/2019, the center did not maintain the required ratios for children from birth to the age of 16 months of one staff member for every four children.

Evidence: 1) At approximately 8:16am, the licensing inspector observed nine children in the infant classroom with Staff #4 and Staff #5.

2) During interview, Staff #4 and Staff #5 confirmed there were a total of 9 children present. The staff reported a third staff member would be arriving at 9:00am.

3) The licensing inspector was informed that Staff #8 was placed in the infant classroom upon her arrival to assist with ratios. A review of the center's time sheet entries showed that Staff #8 arrived at the center at 8:20am. The licensing inspector later observed Staff #8, Staff #4, and Staff #5 in the infant classroom. It is estimated that the ratios were not maintained for approximately five minutes.

Plan of Correction: Per the Center: "Staff was reminded that they must move to maintain ratios the minute another child arrives in the center. Parents were reminded to always let us know if their child will be arriving earlier than anticipated and that sometimes they may have to wait for a teacher to arrive in the classroom to maintain ratios. Our assistant director has been diligently watching ratios on our Brightwheel App on the mornings and we have hired extra staff in the evenings, which allowed us to move our daytime teachers' schedules. They are now able to come in 30 minutes to one hour earlier. The infant room has 3 teachers by 8 am. The toddler room has 2 teachers by 8 am. The 2's room has 2 teachers by 9 am. We have a float teacher by 8 am and Preschool teacher is in by 730 am. We have 2 teachers open at 6 and another one in by 7 plus 2 more by 730. Rooms not being in ratio is not tolerated and has not been an issue since making changes.

We also had two teachers show up late that day and a call off. The teachers that were late were written up and one is no longer employed with us. Safety is our number one concern and we have gone to great lengths to correct everything. We have also hired additional teachers at our other center that can fill in when we are short staffed at this center."

Complaint related: Yes
Description: Based on observations and interviews on 11/06/2019, the center did not maintain the required ratios for children 16 months old to two years of one staff member for every five children.

Evidence: 1) At approximately 8:15am, the licensing inspector observed six children in the toddler's classroom with Staff #3.

2) During interview, Staff #3 confirmed there were a total of 6 children present and a second staff member would be arriving by 8:30am.

3) The licensing inspector observed Staff #6 walk in the toddler's classroom at approximately 8:20am to assist in the classroom.

Plan of Correction: Per the Center: "Staff was reminded that they must move to maintain ratios the minute another child arrives in the center.
