Comments:
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing department on December 12, 2019 regarding allegations of staff inappropriately handling a child. The inspection was initiated on January 15, 2020 and completed on February 3, 2020. On January 15, 2020, the inspector was on site from approximately 10:33am to 4:55pm. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. The inspector completed additional interviews on February 3, 2020.

The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Description: Based on documentation review and interviews, the center did not maintain compliance with their own policies and procedures required by standards.
Evidence:
The center's policies and procedures regarding food policies were not followed on December 5, 2019 when Staff #1 "forced" 6-month old, child #1, to drink milk from a bottle while the child cried, refused the bottle and was heard gurgling milk for approximately 10-15 minutes. Staff #1 reportedly held the child?s face, head and chin to prevent the child from moving her face away from the bottle. The center?s policies and procedures for "Bottle Feeding and Infant Mealtime" states that "Mealtime in the infant room provides unique one-on-one interaction, nurturing, and learning opportunities. To fully utilize these opportunities, children?s mealtime routines should be based on the infant?s individual needs. Mealtimes should be a relaxed and pleasant social event that emphasizes good nutrition and socialization.? These policies and procedures were not followed during the above described incident on December 5, 2019.

Plan of Correction: One-on-one training with all infant teachers regarding feeding policies and positive child guidance. All teachers will sign an acknowledgement form of the above policies

Description: Based on interviews, the facility did not ensure the forbidden action of force feeding did not occur. Evidence: During the January 15, 2020 inspection and on February 3, 2020 the licensing inspector interviewed staff regarding an incident that reportedly occurred on 12/05/2019.
1. Staff #1 stated the following: Staff #1 was feeding child #1 (6-month old) a bottle while holding the child in their arms. Child #1 was refusing the bottle. Child #1 cried while staff #1 was feeding the child the bottle because the child wanted to go to sleep.

2. Staff #2 stated the following: They were in the room with staff #1 and staff #3. Staff #1 was child #1?s (6-month old) primary caregiver. Staff #1 was seen forcing child #1 to finish their bottle at around 5:00pm on 12/5/2019. Child #1 was seen and heard crying, squirming, moving away from the bottle and gurgling milk in the back of their throat. Staff #1 was seen holding child #1 in their arms while "forcing" a bottle in child #1?s mouth for about 10-15 minutes, while holding the child?s chin and forehead. At the end of the day, child #1?s parent noticed red spots on the child.

3. Staff #3 stated the following: At around 5:00pm on the day of the incident, staff #1 was seen caring for two infant children. Child #1 (6-month old) was triggered by the other child?s cry and began to cry. Staff #1 was holding child #1 in their left arm while feeding the child with their right hand. Staff #1 was seen holding child #1?s face and ?shoving? a bottle in child #1?s mouth on and off for about 10-12 minutes. During that time child #1 was seen moving their head trying to avoid the bottle, crying and gurgling milk. Staff #1 kept insisting the child had to eat and the milk had to be saved because it was breast milk. Red marks were notice on child #1?s cheeks, forehead and back of their neck.
