Comments:
The licensing inspector conducted a self-reported unannounced other inspection on 02/05/2020. Staff were interviewed and documentation obtained regarding the report of a staff member using a forbidden action towards a child in care. There was a violation resulting from this reported incident and subsequent inspection.Thank you for your cooperation. This inspection began at 8:45 am and concluded at 10:45 am.

Violations:
Standard #: 22VAC40-185-410-1
Description: Based on interviews with staff, the facility failed to ensure that staff did not use a forbidden action of striking a child for behavior guidance.

Evidence:
Based on staff interviews on 02/05/2020, it was determined that staff #1 struck child #1, who is 3 years old, on the top of the hand 2 times and once in the mouth on 02/04/2020 at approximately 8:15 am.

Staff #4 and #5 stated that "staff #1 smacked the child on top of the hand 2 times and once in the mouth while he was having his anger fit and was in time out". Staff #4 and #5 stated that staff #4 was crouched down in front of the child, while he was in time out, trying to talk the child down when the child then swung to hit staff #4. When this happened, staff #1 intervened and smacked the child on the hand and mouth stating "you will not hit your teachers".

Both staff #4 and #5 stated that the smacks did provide a "noise" when the open palm of staff #1's hand made contact with the child's hand and mouth. Staff #4 and #5 stated the child did not have any marks on his hand or mouth.

Plan of Correction: The staff member was immediately terminated. All staff will sit down with cooperate staff to review and re-sign the Zero Tolerance policy form and review the expectations of appropriate behavior guidance and interactions with children. Also, all staff will be reminded during this sit down of the consequences of not following the signed form.
