The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing office on 12/3/19. Interviews were conducted with children and staff relating to allegations that a staff member restrained and failed to protect a child in care. The preponderance of the evidence gathered during the investigation supports the allegations.
An Intensive Plan of Correction will be requested.

Standard #: 22VAC40-185-400-B Complaint related: Yes Description: Based on interviews and video coverage the center failed to ensure that behavioral guidance is constructive in nature, age and stage appropriate and intended to redirect children to appropriate behavior and resolve conflicts.
Evidence:
1. The video surveillance shows staff #1 attempting to get child #1, an 11 year old male, to leave the classroom. Child #1 had dropped to the floor as staff #1 was approaching him. Staff #1 bent at the waist and wraps both her arms under the armpits and around child #1's body. Staff #1 is then seen dragging child #1 across the room to the door. Staff #2 holds the door open so staff #1 could get child #1 out into the hallway.Plan of Correction: See Intensive Plan of Correction
Standard #: 22VAC40-185-410-1 Complaint related: Yes Description: Based on video coverage reviewed and interviews the center failed to ensure that no child is roughly handled by staff.
Evidence:
1. Child #1 is an 11 year old male.
2. An undetermined incident occurred in this classroom on 11/26/19, resulting in the following actions.
3. Staff # 1 stated that she told child #1 "you have two choices-get up and walk or I'll carry you".
4. Video surveillance shows staff #1 attempting to get child #1 to leave the classroom by pointing her arm at child #1 and then back to the door that she held open. Staff #1 then swiftly walked to where child #1 is standing in the corner of the room. Child #1 dropped to the floor then, Staff #1 bends at the waist and wraps both her arms under the armpits and around child #1's body. Staff #1 straightens up and the video shows that child #1 is tightly held against staff #1's body with child #1's arms flailing and extended up and over his head. Staff #1 holds and drags child #1 in this position with his feet bumping and bouncing against the floor and between her legs out of the classroom while staff #2 holds the door open.
5. A witness reported that child #1 sat down in the hall and staff #1, "had to pull him up with his arms". This occurred from the classroom to the front desk area.
6. A second witness stated that Staff # 1 was in the hallway with child #1. Child #1 was on the floor and Staff #1 was heard saying "you need to get up and walk or I will make you get up and go to the office." This witness could then hear child # 1 in the office area with staff #1. Child # 1 said "you are hurting my arm."Plan of Correction: See Intensive Plan of Correction
