Comments:
An unannounced renewal inspection was conducted on 2/27/20 from 10:15am until 12:25pm. At the time of entrance, there were 71 children in care with 9 staff. 19 children and 2 staff returned from a field trip at the end of the inspection. A sample of 7 children's records and 7 staff records were reviewed. Children were observed participating in learning activities, playing outside, eating lunch and resting quietly during nap time. Hand washing and restroom procedures were also observed. Medication, the emergency preparedness plan, first aid and emergency supplies, documentation of emergency practice drills, children's injury reports and center postings were reviewed. Three violations in the areas of administration and background checks are identified on the violation notice and were discussed with administrative staff during the exit interview.

Standard #: 22VAC40-185-160-C
Description: Based on record review and interview, the center did not ensure that staff members shall obtain and submit the results of a follow-up tuberculosis screening at least every two years from the date of the first initial screening or testing.

Evidence:
1. The most recent tuberculosis screening for staff 5 is dated 10/30/17. Staff 5 was due for an updated tuberculosis screening in October 2019 and was working on the day of the inspection.
2. Staff 5 confirmed that her tuberculosis screening is overdue.

Plan of Correction: The center responded with the following: Staff 5 will obtain a new TB screening by the end of next week and the results will be placed in her file.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review and interview, the center did not ensure that they obtain the results of the fingerprint based background check prior to the first day of employment or that all employees hired prior to January 22, 2018 have a completed fingerprint based national criminal history record check by September 30, 2018.

Evidence:
1. The record for staff 1 (owner) does not contain documentation of a completed fingerprint based national criminal history record check. There was a completed Virginia criminal record check dated 5/19/16. Staff 1 confirmed that he has not completed the fingerprint based background check.
2. The record for staff 2 (owner) does not contain documentation of a completed fingerprint based national criminal history record check. There was a completed Virginia criminal record check dated 5/19/16. Staff 2 confirmed that she has not completed the fingerprint based background check.
3. Staff 3 has a date of hire of 11/4/19. The results of the fingerprint based background check for staff 3 was not received until 1/13/20.
4. Administrative staff confirmed that staff 3 began employment prior to the results of the fingerprint based background check being received.

Plan of Correction: The center responded with the following: Staff 1 and staff 2 have appointments scheduled for 2/24/20 to complete the fingerprint background check. Once received, the results will be placed in their files and forwarded to licensing.
Going forward, the center will ensure that all new employee fingerprint check results are received before hire.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review and interview, the center did not ensure that staff who have lived outside of the state of Virginia within the past 5 years obtain a central registry check from that state.

Evidence:
1. Staff 3 has a hire date of 11/4/19. Staff 3 indicated on her sworn statement or affirmation that she has resided in the state of South Carolina within the past five years. There is no documentation that a request for an out of state central registry check was sent to South Carolina for staff 3.
2. Staff 4 has a hire date of 11/4/19. Staff 4 indicated on her sworn statement or affirmation that she has resided in the states of California and Hawaii within the past five years. There is no documentation that a request for an out of state central registry check was sent to California or Hawaii for staff 4.
3. Administrative staff confirmed that out of state central registry checks were not requested for staff 3 and staff 4.

Plan of Correction: The center responded with the following: Out of state central registry search requests will be mailed out by 2/28/20. Once obtained, the results will be placed in staff files and forwarded to licensing. Going forward, administrative staff will ensure all background checks are completed within the required timeframes.
