63.2(17) License & Registration Procedures

Comments:
An unannounced renewal inspection was conducted on March 4, 2020 from approximately 12:05 pm-3:30 pm. Upon arrival to the facility, there were eight children in care with one staff person and one volunteer. The children ranged from 15 months old to three years old. The children were observed watching children's programming, preparing for nap and resting. Areas of noncompliance are identified on the Violation Notice. Exit interview was conducted with the Owner/Program Director.

Violations:
Standard #: 22VAC40-185-130-A
Description: Based on record review, in two of five children's records reviewed, the licensee did not ensure that each child has received the immunizations required by the State Board of Health before the child can attend the center.

Evidence: The Director confirmed that there was no documentation of immunizations in the records for Child #2 and Child #4; both children were present on the date of the inspection.

Plan of Correction: Director will contact parents and obtain the correct paperwork.

Standard #: 22VAC40-185-60-A
Description: Based on record review, in five of five children's records reviewed, the licensee did not ensure that each child's record was maintained with all required information.

Evidence: The Director confirmed that the following information had not been documented in each child's record:

Child #1 and Child #5-start date

Child #2-full home address for one parent; the name, address, phone number, place of employment and work phone number for the second parent; a complete address for two persons to contact in the event of an emergency

Child #3-start date; a complete address for two persons to contact in the event of an emergency

Child #4-the name, home address, phone number, place of employment and work phone number for one parent; a complete address for one person to contact in the event of an emergency

Plan of Correction: The records will be fixed by March 7, 2020.

Standard #: 22VAC40-185-70-A
Description: Based on record review, in one of two staff records reviewed, the licensee did not ensure that each staff record contained all required information.

Evidence: The Director confirmed the following regarding staff/volunteer records:

1. There was not an established record for a volunteer present on the date of the inspection. The Director confirmed that there was no documentation of the volunteer's name, address, verification of age requirement, job title, and date of volunteering; and name, address and telephone number of a person to be notified in an emergency

2. The record for Staff #1 did not include documentation that two or more references as to character and reputation as well as competency were checked before employment and documentation of orientation training.

Plan of Correction: Director will require all missing paperwork as well as conducting orientation on March 9th.

Standard #: 22VAC40-185-280-B
Description: Based on observation and inspection of the facility, the licensee did not ensure that hazardous substances shall be kept in a locked place using a safe locking method that prevents access by children. If a key is used, the key shall not be accessible to the children.

Evidence: The following unlocked hazardous substances labeled keep out of reach of children and warning or caution, were observed in the center:
1. There was a can of air freshener on a shelf in the bathroom of the front hallway.
2. In the One Year Old classroom, there were two bottles of hand soap and one container of wipes in an unlocked cabinet. There was a safety latch on the cabinet that had not been secured.

Plan of Correction: Those items will be corrected and locked.

Standard #: 22VAC40-185-350-E-1
Description: Based on observation and inspection of the facility, the licensee did not ensure that ratios were maintained for children from birth to 16 months: (one staff/four children).

Evidence: The Director confirmed that there was one staff member and one volunteer with eight children.

Plan of Correction: The volunteer will have the necessary paperwork by the end of June. The floater that was on board had to leave for an emergency situation.

Standard #: 22VAC40-185-560-F
Description: Based on review, the licensee did not ensure that when the center chooses to provide meals or snacks, the center shall follow the most recent, age-appropriate nutritional requirements of a recognized authority such as the Child and Adult Care Food Program of the United States Department of Agriculture (USDA).

Evidence: The posted menu indicated that today's morning snack was poptarts and water and the evening snack was cheese balls and water. There was not a second nutritional snack component identified on the menu.

Plan of Correction: Director will update the menu.
