Comments:
A self-reported incident was received in our office on February 4, 2020 concerning supervision and care and protection of a child. An unannounced investigation was conducted February 10, 2020 from 9:30am-1:00pm. There were 91 children (infants-5yrs.) supervised by 17 direct care staff. Based on interviews with staff and review of written statements, violations were documented regarding the self-reported incident. Areas of non-compliance are identified in the Violation Notice. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on a review of the center's policies and procedures it was determined that the licensee did not ensure that the center's activities and services are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards.

Evidence:
1.Center did not follow their own procedure of providing adequate supervision as stated in the Cadence Education Classroom Safety Handbook. ?It is the responsibility of every staff member, including the management team, to be accountable for every child in the building or on the playground while the child is in attendance and to provide adequate supervision at all times?.
? Always position yourself?both inside and outdoors? so that you have maximize your opportunity to hear or see all the children at all times and can render immediate assistance;
? Interact with children at all times, both while seated and while walking about.
? Be aware of children?s activities at all times;
? Provide supervision appropriate to the individual age, needs and capabilities of each child.
2. Staff #2 stated that on February 4, 2020 they observed staff #1 coming out to the playground from the two-year-old classroom (ladybug room) with child #2, (age 3) at approximately 3:25pm.
3. Staff #2 observed staff #1 running from the playground towards the two-year-old classroom (busy bees room) at approximately 3:28pm.
4. Staff #1 stated, ?I saw the child (child #1) in the window of the two-year-old classroom (busy bees room) and I went to go get the child?( #1).

Plan of Correction: Staff #1 was terminated. Procedures regarding children that need to return to the classroom after entering the playground have been reviewed. All staff were retrained on supervision procedures, including Name to Face, during our staff meeting on Feb. 17th

Standard #: 22VAC40-185-340-A
Description: Based on interviews with staff #2 and 3 and review of documented written statements from staff #1, 2 and 4, it was determined that staff-supervising children, did not always ensure their care and protection.
Evidence:
1. Staff #1 was in the two-year-old classroom (busy bees room) with child #1, (age 2) and child #2 (age 3) to use the restroom. They entered the classroom using the door from the playground area.
2. Staff #2 stated that on February 4, 2020 they observed staff #1 coming out to the playground from the two-year-old classroom (busy bees room) with child #2, (age 3) at approximately 3:25pm.
3. Staff #1 stated, ?I saw the child (child #1) in the window of the two-year-old classroom (busy bees room) and I went to go get the child? (#1).

Plan of Correction: Staff #1 has was terminated. .

Description: Based on interviews with staff #2, and #3, and review of documented written statements from staff #1, #2 and #4, it was determined; children under 10 years of age were not always within actual sight and sound supervision of staff.
Evidence:
1.Staff #1 was in the two-year-old classroom (busy bees room) with child #1, (age 2) and child #2 (age 3) to use the restroom. They entered the classroom using the door from the playground area.
2.Staff #2 stated that on February 4, 2020 they observed staff #1 coming out to the playground from the two-year-old classroom (busy bees room) with child #2, (age 3) at approximately 3:25pm.
3. Staff #2 observed staff #1 running from the playground towards the two-year-old classroom (busy bees room) at approximately 3:28pm.
4. Staff #1 stated, ?I saw the child (child #1) in the window of the two-year-old classroom (busy bees room) and I went to go get the child? (#1).
5. Staff #3 went into the two-year-old classroom (busy bees room) at 3:30pm and observed staff #1 and child #1 in classroom.
