Comments:
An announced non-mandated focused inspection was conducted on 03/10/2020 as the result of a self-reported incident that took place on 03/04/2020. The following took place during the investigation: review of video footage, the review of child and staff records, the review of policies/procedures and staff interviews. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on review of video footage, review of written documentation of the facility?s policies and interviews with the staff, the facility failed to ensure compliance with its own policies that are required by the standards.

Evidence:
1. Video footage and interviews with the staff confirmed that on 03/04/2020, Staff #1 did not following the facilities Discipline and Behavior Management & Child Guidance Policy when Staff #1 hit Child #1 with a plastic ruler on the hand and in the face. The facilities Discipline Plan states ?There shall be NO physical punishment or disciplinary action administered to the body?. The Behavior Management & Child Guidance Policy states ?State Licensing and Department of Health and Human Services (HHS) Performance Standards prohibit the use of corporal punishment, total or extended isolation as a child management tool. The withholding of food, basic needs or participation in special events, name calling, ridicule or any form of demeaning or frightening treatment is strictly forbidden?. The standards of conduct for employees document states the following: #4 ?I will use positive methods of child guidance and will not engage in corporal punishment, emotional or physical abuse or humiliation. I will not employ methods of discipline that involve isolation, the use of food as a punishment or reward or the denial of basic needs?, #5 ?I will refrain from all forbidden actions as stated in the Department of Social Services Standards for License Child Day Center 22VAC40-185-410?.
2. The record for Staff #1 contained documentation of a signed acknowledgement of receiving this information in writing; the documents were signed and dated 08/06/2018.

Plan of Correction: The facility will review the standards of conduct, state standards and Head Start Performance standards as they pertain to child discipline.

Standard #: 22VAC40-185-410-1
Description: Based on review of video footage and interviews with the staff, the facility failed to ensure that actions towards children that are forbidden by the standards (physical punishment, striking a child, roughly handling or shaking a child) were not used at the center.

Evidence:
1. The video footage (there is no audio) from 03/04/2020 at approximately 2:24 p.m. shows Child #1 playing in the computer center area of Classroom #2. Staff #1 then bends at the hips and gets close to Child #1's face. Staff #1 then grabs the right hand of Child #1 with her left hand and walks Child #1 across the classroom towards the door. While walking across the classroom, Staff #1 can be seen hitting Child #1 at least 5 times on the right hand and twice on the left side of the face (the temple area) with the green ruler.

Plan of Correction: The facility will: have training on conscious discipline and will use video footage for ongoing monitoring. These plans will be put into action once the program reopens.

Standard #: 22VAC40-185-420-A
Description: Based on document review and discussion with the staff, the facility failed to ensure that before the child?s first day of attending, parents shall be providing in writing with the information, policies and procedures as stated in the standards.

Evidence: The 2019-2020 Parent Handbook did not contain the following required information: information regarding holidays, the center?s policy regarding application of: sunscreen, diaper ointment or cream and insect repellent, discipline policies including acceptable and unacceptable discipline measures, and termination policies.

Plan of Correction: Ensure all required information is in new parent handbook for the 2020-2021 school year.
