Comments:
The licensing inspector conducted an unannounced complaint inspection on 02/26/2020 in response to a complaint that was received in the licensing regarding allegations in the area of Administration and Emergencies. Interviews were conducted with staff, records reviewed and observations of the program were made relating to the allegation. The information gathered during the investigation supports the allegations, so the complaint is determined to be VALID.

Description: Based on interviews with staff and a review of the center's emergency preparedness plan, the center did not ensure
their activities complied with their own policies.
Evidence:
On February 20th, between the hours of 2:00 pm and 4:30 pm, the center building was evacuated due to a carbon monoxide leak in the building's HVAC system.

1. Page 12 of the center's emergency preparedness plan states, the decision to evacuate the building will be made by the Director. The plan further states, when the decision is made to evacuate the center building, the director is to announce the evacuation and/or pull the fire alarm.
1. When a carbon monoxide detector indicated high levels of the toxin in the building, the director did not initiate an evacuation of the building. It was reported, staff #5 initiated the evacuation by grabbing children's coats and telling classrooms to evacuate.
2. It was reported by staff there was not a sounding of an alarm indicating the need for evacuation. The director confirmed she did not pull the fire alarm to notify staff to evacuate, nor did she announce an evacuation.

Plan of Correction: The following corrective action was provided by the director after the exit interview:
We evaluated the current emergency preparedness plan. We updated and trained staff using the new plan.

Description: Based on interviews with staff and record review, the center did not ensure children's records were treated confidentially.
Evidence:
On February 20th, the center was evacuated due to a carbon monoxide leak in the building's HVAC system. Staff # 6 was transported by ambulance with other staff to be checked for poisoning at hospital. Staff # 6 left the classroom's emergency notebook containing the children's emergency information and over-the-counter skin care authorizations on the ambulance. Staff and the diretor reported as of the date of inspection, the notebook and its contents had not been retrieved.

Plan of Correction: The following corrective action was provided by the director after the exit interview:
Staff was retrained on confidentiality.
