Comments:
An investigation was conducted on 2/11/2020 and a follow up was conducted on 2/20/2020, in response to a self-reported incident reported to the Fairfax Licensing Office on 2/6/2020 regarding behavioral guidance, ratios and special services. Based on interviews conducted, observations and review of documentation, the preponderance of evidence gathered during the investigation does support violations. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on review of the center's policies and procedures, and staff interviews, it was determined that the center did not ensure that staff followed the center's own policies and procedures required by the standards for guidance, protection and respect for children.

Evidence:
The center's policy on guidance, protection and respect for children states:
- "Employees should use only positive guidance such as redirection, praise and modeling of pro-social behavior, setting clear expectations and classroom rules, and verbal interventions."
- "Employees are required to use positive guidance techniques and to refrain from any unacceptable measures while caring for children on behalf of the Company."
- "Separation techniques must never be used as punishment."
- "Employees will support the emotional development of young children by using positive interactions."
- "Withholding or limiting food, naps, or access to bathroom facilities is strictly prohibited".

1.On the day of the incident 2/5/2020 Staff#1 did not:
A) Follow the center's guidance, protection and respect for children policy when they did not use redirection, positive guidance techniques or interactions and instead separated Child#1, age 9, from the group and instructed the child to remain seated for approximately 40 minutes.
B) Allow Child#1 to get second helpings of food during snack time because the child did not help clean up the classroom.

Plan of Correction: -Center management will review with staff KCE policies regarding ratios, positive child guidance, and interactions.
-Additional resources will be given to staff to support them in the classrooms and acknowledgements will be signed.
-District leader and center management will continue to coach and manage based on KinderCare policies and procedures.

Standard #: 22VAC40-185-350-E-5
Description: Based on interview and record review, the center did not ensure required ratios were maintained for children, from age of eligibility to attend public school through eight years, one staff member for every 18 children.

Evidence:
1. The Child Supervision Record (CSR) maintained by the center for the after school program revealed that on 2/5/2020, the center did not meet the required staff-to-children ratios of one staff member for every 18 children for the school age program.
2. According to the school age classroom CSR on 2/5/2020 the ratios were as follows:
- Approximately from 4:10pm to 4:30pm, the ratio was 1 staff member with 19 children.
- Approximately from 4:30pm to 4:45pm, the ratio was 1 staff member with 26 children.
- Approximately from 4:45pm to 4:55pm, the ratio was 1 staff member with 23 children.
- Approximately from 4:55pm to 5:25pm, the ratio was 1 staff member with 19 children.
3. Staff#1 confirmed on 2/13/2020 and Staff#3 confirmed on 2/11/2020 that the school age classroom was over ratio on 2/5/2020.

Plan of Correction: -Center management will review the licensing standards regarding ratios within each age group and make corrections appropriately to schedules.
-Additional resources will be given to staff to help with CSR usage and alerting management of "real" time numbers to avoid overage in proper ratios.
-District Leader will continue to have conversations with all center employees around the importance of compliance and supervision safety.
-District Leader will conduct random visits to observed proper ratios.

Standard #: 22VAC40-185-400-B
Description: Based on interview, the center did not use behavioral guidance that was constructive in nature, age and stage appropriate.

Evidence:
1.Child#1, age 9, stated that during snack time on 2/5/2020, Staff#1 grabbed their arm, walked them to the classroom's door, pushed them against the wall and told them, "You needed to sit down because you don't act your age". Child#1 stated that the incident occurred at the end of snack time, and that they remained seated on the floor, without access to any activities, until the child's parent arrived to pick them up, at approximately 5:35pm.
2.Staff#2 stated that upon entering the classroom at approximately 5:25pm and as Staff#1 was getting ready to leave, staff#1 said to them, "Child#1 needs to stay there because they didn't follow any rules today."
3.Staff#1 stated that they asked Child#1 to sit down at approximately 4:45pm because the child was not helping clean up the classroom. Staff#1 also stated that they never touched the child, and that although they instructed them to sit down, it was the child's choice to sit on the floor by the classroom's door for approximately 40 minutes.

Plan of Correction: -Staff involved was terminated after conclusion of findings.
-All remaining staff will be retrained on KCE policies on Positive Child Guidance and NAEYC Child Interaction Practices.
-Management will continue to monitor and work with staff on classroom routines, techniques, and behavioral management.
-Management will complete classroom observations and provide feedback.
-Administrative actions will be taken if any staff continue to not follow our supervision standards.
-District Leader will do unannounced visits to the center to ensure that staff are being retrained and that observations are completed.

Standard #: 22VAC40-185-560-F
Description: Based on interview, children were not allowed second helpings of food listed in the USDA's child and adult care meal patterns.

Evidence:
1. On 2/5/2020, cheese sticks and crackers were served for snack to the school age children.
2. Child#1. age 9, stated that on the day of incident they requested second helpings of cheese sticks from Staff#1, but Staff#1 said they couldn't have second helpings because they didn't help clean up.
3. Staff#1 stated that at approximately 4:45pm, Child#1 requested more cheese sticks but there weren't any more cheese sticks available, Staff#1 then offered more crackers but the child refused to take more crackers.
4.Staff#2 stated that when they entered the classroom at approximately 5:25pm, there were second helpings of cheese sticks available and they were offered and accepted by the child at that time.

Plan of Correction: -KinderCare Food Program reps will come on within the quarter to conduct a USDA verification visit.
-All Staff will be retrained on USDA requirements and portion sizes.
-Center management will make sure that one observation completed in each classroom is done during mealtime service.
