Comments:
An unannounced complaint inspection was conducted on 02/24/2020 in regards to information received regarding non-compliance with ratios. An inspection was conducted and there were 4 violations, in 2 separate areas, cited. This complaint is deemed valid. If you have any questions please contact me. Thanks for your time. This inspection began at 8:30 am and concluded at 10:45 am.

Violations:
Standard #: 22VAC40-185-230-B
Complaint related: No
Description: Based on observations and discussions with staff the facility failed to maintain compliance with this standard as required related to sight and sound supervision by staff.

Evidence:
On 02/24/2020 the LI observed two different times where children in care of the center were alone with and being supervised by the two staff with Melody Makers. These independent contractors are to be within sight and sound supervision of staff employed with the center while with children as there are no background checks or staff files for these contractors. The times were approximately 9:40 am-10:04 am with 5 children and approximately 10:08 am-10:34 am with 7 children.

Plan of Correction: The PD will ensure that a teacher will be with any outside contractors that are with the children. 4/1/2020

Description: Based on observations and discussions with staff the facility failed to maintain compliance with this standard as required related to toddler aged ratios.

Evidence:
On 02/24/2020 the LI observed that there were 12 toddlers with 2 staff for approximately 15 minutes from approximately 8:33 am-8:48 am. The required ratio for this toddler class was 1 staff to 5 children.

Plan of Correction: The PD has worked closely with H/R to adjust schedules. 3/6/2020

Complaint related: Yes
Description: Based on observations the facility failed to maintain compliance with this standard as required relating to ratios for preschool aged children.

Evidence:
The LI observed on 02/24/2020 the following times of non-compliant ratios in classes 3 years-5 years:
1) At approximately 9:18 am there were 11 children in care in the Pre-K 1 class with 1 staff.
2) At approximately 9:42 am the 12th child arrived for care in the Pre-K 1 class with 1 staff.
3) At approximately 9:58 am there were 11 children in care in the Pre-K 2 class with 1 staff.
4) At approximately 10:12 am there were 11 children in care in the Preschool 1 class with 1 staff.

The required ratio for all classes mentioned above was 1 staff to 10 children.
Ratios were not corrected until approximately 10:35 am when children were moved around into different classes to have correct ratios in each class.

Plan of Correction: The PD has worked closely with H/R to adjust schedules and floater has been hired for open position and head counts will be taken during early mornings to see if any staff schedules need to be addressed. 3/6/2020

Description: Based on observations and discussions with staff the facility failed to maintain compliance with this standard as required relating to moving of children to different classes to aide in compliance.

Evidence:
A total of seven children were moved to different classrooms to meet compliance with ratios. These children are not normally in these classrooms, but due to staff shortage and ratio issues they were moved by center administration per guidance received via a phone conversation, at 10:15 am, with cooperate while the inspector was present.

The classes affected by this moving of children were:
Preschool 1, Preschool 3, Pre-K 1, Pre-K 2, toddler 2, and Two's 1.

Staff disclosed that this is a normal occurrence weekly due to not having enough staff for enrollment.

Plan of Correction: The PD has worked closely with H/R to adjust schedules and floater and 2-year-old lead has been hired for open positions and head counts will be taken during early mornings to see if any staff schedules need to be addressed. 3/13/2020
