Technical Assistance:
Technical assistance was offered regarding accurate documentation of children being transported for field trips and scheduled van runs before and after school care.

Comments:
An unannounced inspection was conducted on 03/12/2020 in response to a complaint that was received on 03/06/2020. The allegations were related to the center not meeting staff qualifications in the infant classroom and staff's oral communication skills. Interviews were conducted with four staff members. Four staff records were reviewed and classroom observations were made. The information gathered during this investigation supports the allegations, so the complaint is determined to be valid. Please complete the columns for "Plan of Correction" and "Date to be Corrected" for each violation cited on the violation notice, and then return a signed and dated copy within 5 business days of the receipt. Standard #: 22VAC40-185-180-B
Complaint related: Yes
Description: Based on staff interviews, two staff members were not capable of
communicating effectively orally as applicable to their job responsibility.
Evidence:
1. When interviewed on 03/12/2020, Staff #2 responded to questions with,"No hablo Ingles".
2. When Staff #1 was interviewed about Staff #2's ability to speak English, Staff #1 stated that she has trouble when orally communicating with Staff #2; and that it is hard to explain curriculum activities and unexpected schedule changes related to the classroom to Staff #2.
3. In response to the request to interview Staff #3, Staff #4 stated that Staff #3's English was not good.
4. When Staff #1 was interviewed about Staff #3's oral communication skills in English, Staff #1 stated that Staff #3 has limited English and understands "broken English".
5. When interviewed, Staff #3 could not respond to any questions in English.
6. When Staff #4 was interviewed about Staff #2 and Staff #3's English speaking skills, Staff #4 stated that Staff #2 and Staff #3 had limited English speaking skills.

Plan of Correction: Staff #2 has since resigned. Staff #3 will sign up for additional English classes.

Complaint related: No
Description: Based on record reviews and staff interview, a program leader did not meet the qualification requirements as listed in the standards.

Evidence:
1. On 03/12/2020, Staff #4 stated that Staff #1 has been the program lead in the infant classroom over three months.
2. Staff #1's record did not include documentation that verified Staff #1 was qualified for the lead position. The record included documentation of a high school diploma and a college transcript showing only nine hours of college credit related to the care of children.
3. Since becoming the program lead, Staff #1 did not receive 24 hours of training related to the care of children.

Plan of Correction: Staff #1 will complete the requisite 24 hours of training.

Standard #: 22VAC40-185-340-D
Complaint related: Yes
Description: Based on interview, record review, and observation, one classroom did not have at least one staff member who met the qualifications of a program leader who was regularly present and who did not supervise more than two aides.

Evidence:
1. Staff #4 identified Staff #1 as being the program lead for the infant classroom.
2. Staff #1 does not meet the qualification of the program lead as specified in Standard 22 VAC 40-185-210.A.
3. Staff #1 was observed in the role of the program lead for the infant classroom, and was observed supervising three aides with 12 infants.

Plan of Correction: Going forward, a second lead qualified teacher will be in the classroom.
