Comments:
An unannounced complaint investigation was conducted on December 12 and December 13, 2016 in response to a complaint that was received in the Valley Licensing Office on December 9, 2016. The allegation was in regards to 63.2-(1)-100-1 of the Code of Virginia. On December 12, 2016, at the time of the inspection, there were 18 children in the care of three staff members. The preponderance of the evidence gathered during the investigation did not support the allegation and the complaint disposition was, therefore, "not valid." There were violations of the Code of Virginia involving Religiously Exempt Child Day Centers that were not complaint related. They are documented on the Violation Notice. Complaint related: No
Description: Based on review of staff records and verification from staff, the center failed to obtain the required background checks on two staff members. These two staff members were in direct contact with children and working alone with children without having an original criminal record clearance on file. Evidence: 1. The record of Staff Member #1 did not contain a criminal record check, a search of the central registry, or a sworn statement. Date of hire for Staff Member #1 was 08/31/2011. Staff Member #1 was working alone with children, without being supervised by a staff member that had completed criminal record check on file. 2. The record of Staff Member #2 did not contain a criminal record check, a search of the central registry, or a sworn statement. Date of hire for Staff Member #2 was 09/05/2011. Staff Member #2 was working alone with children, without being supervised by a staff member that had completed criminal record check on file. 3. Staff Member #1 confirmed there were no background checks on file for either staff member and that both staff members worked alone with children while not being supervised by a staff member that had a completed criminal record check on file.

Plan of Correction: I will have each staff fill out a sworn statement. I will submit form 230 for the state police and submit background forms for CPS. I will contact the licensing department as soon as background checks are returned.

Description: Based on review of children's records and verification from staff, the center failed to view or obtain proof of one child's age and identity. Evidence: 1. The record of Child B did not include documentation that the person enrolling the child had presented the center with proof of the child's age and identity. First day of attendance for Child B was 08/25/2015. 2. Staff Member #1 verified that proof of age and identity was not in the file for Child B.

Plan of Correction: I will contact the child's parents by the phone and email for them to bring the information in.
