63.2(17) License & Registration Procedures

Technical Assistance:
New employees need to request an out-of-state central registry check within 30 days of hire.
Current employees and licensees must request an out-of-state central registry check by September 1, 2017 for any individual who has lived in another state in the past five years.

Standard 70.A.2 - Staff reference checks was reviewed

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was initiated on 05/12/2020 and concluded on 05/13/2020. The director was contacted by telephone to initiate the inspection. There were 15 children present and 7 staff. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed 3 children's records and 3 staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review and interview, the licensee failed to obtain a copy of the results of a search of the central registry maintained pursuant to ? 63.2-1515 and any child abuse and neglect registry or equivalent registry maintained by any other state in which the individual has resided in the preceding five years for any founded complaint of child abuse or neglect against him.

Evidence:
1. The results of an out-of state central registry check are not available for staff 1.
a. Staff 1 has a hire date of 02/23/2018 and has resided in the State of North Carolina within the past five years prior to employment.
b. Staff 1 provided written information to the facility stating she has resided in North Carolina prior to employment.
2. A central registry check from the State of Georgia was not obtained until 05/13/2020 for staff 2.
a. Staff 2 stated that she resided in The State of Georgia from from June 2009 - July 2016.
b. As an existing staff, staff 2 was required to obtain an out-of-state central registry check no later than 09/01/2017.
3. The program director confirmed that out-of-state CPS checks had not been obtained for staff 1 and staff 2 within the required time frames.

Plan of Correction: All employees that reside out of state shall have a central registry check within 30 days of employment. Request for staff 1 and 2 were completed on 05/13/2020.
