Comments:
The center self reported a situation involving inadequate care, protection and guidance, inappropriate behavioral guidance and not following transportation procedures. Interviews, observation and a review of documentation were conducted and the information gathered during this investigation determined non-compliance with the standards and a violation notice was issued to the facility.

Violations:
Standard #: 22VAC40-185-340-A
Description: Based on interview and a review of documentation, it was determined that the center failed to ensure care, protection and guidance of children in care.
Evidence:

1. Based on interviews, it was determined that Staff A picked up Child A, B and C, from a local middle school on 2/21/20 at approximately 3:10 pm in the center?s van. Staff A asked the 3 children to put on their seat belts but failed to follow the center?s procedure of doing a safety check by walking the isle of the van to verify seat belts were on. Consequently, none of the three children put on their seat belts. Interviews further revealed that staff A routinely would not do the safety checks by walking the length of the van to verify seat belts were fastened. Consequently these three children would routinely not wear their seat belts when transported by staff A. The van ride from the school to the center is approximately a 10 to 15 minute drive.
2. After turning off Wellington Road and onto Dean Park Lane (entrance to the center) staff A looked into the rear view mirror and realized a child(ren) were not wearing their seat belts and as a result, started swerving and jerking the van back and forth and then slammed on the breaks, this resulted in child A falling out of their seat and hitting their head on the metal window frame.
3. Staff A confirmed that child A had complained of hitting their head but the staff failed to check the child's head for potential injury and only after dropping the child off and leaving to do another pick did Staff A call the front desk 1 to 2 minutes later and ask them to check on the child.
4. Interviews with the schoolagers revealed that some of them were scared and afraid by Staff A?s swerving and jerking and slamming on the breaks.

Standard #: 22VAC40-185-400-B
Description: Based on interviews, it was determined that the center and its staff are not practicing behavioral guidance that is constructive, appropriate and intended to redirect children to appropriate behavior.
Evidence:
1. Interviews revealed that while transporting three middle school children ( A, B and C) Staff A saw in the rear view mirror that a child(ren) were not wearing seat belts and staff A started to drive ?crazy? and began to swerve and jerk the van back and forth and then slammed on the breaks which resulted in child A falling out of their seat and hitting their head on the metal window frame.
2. After slamming on the breaks, interviews revealed that staff A said something similar to , that?s why you wear your seat belts and the erratic driving was on purpose to teach the children a lesson.

Description: Based on interviews, it was determined that the center was not acting in a responsible manner from the time children boarded the center?s van until the children were returned to their parents.
Evidence:
Interviews revealed that on 2/21/20 at approximately 3:10pm that staff failed to be responsible for three middle school children who boarded the center?s van at their school and were transported back to the center.
Evidence:
1. Upon pick up, staff A did not check to make sure the three schoolagers were wearing their seat belts before driving off.
2. After child A hit their head on the window frame after falling out of their seat, Staff A never looked at child A?s head to assess the injury area but instead dropped off the three children and drove off to pick up another group of children. Approximately one to two minutes later, staff A did call back to the center and spoke to staff at the front desk and reported that child A fell out of his seat and hit his head and that child A had complained of his head hurting and Staff A wanted the front desk staff to check on the child

Standard #: 22VAC40-185-580-C
Description: Based on interviews, it was determined that the center and its staff did not ensure that during transportation of children, the Virginia State statutes about safety belt laws were followed.
Evidence:
1. On 2/21/20 at approximately 3:10 pm, three middle school age children were picked up by Staff A and transported back to the center, approximately a 10 to 15 minute van ride without wearing their seat belts.
