Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A complaint inspection was initiated on 5/22/2020. Additional information was obtained from the facility on 6/29/2020 and reviewed on 6/30/2020. A complaint was received by the department regarding allegations in the area of supervision. The director was contacted by telephone to conduct the investigation. The evidence gathered during the investigation supported the allegation of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Standard #: 22VAC40-185-40-E
Complaint related: No
Description: Based on interviews with staff and review of supervision policies, the facility failed to follow the center's own policies and procedures that are required by these standards. Evidence: the center's playground supervision policy states, "Always be aware of the number of children being supervised". The supervision policy states "Teachers should keep children within sight and sound at all times including bathrooms and nap times." On May 11, 2020, Child A (age 2) was out of sight and sound supervision, after leaving the playground undetected, and the staff were not aware he was missing.

Plan of Correction: The gates have new latches. A staff member is assigned to check all gates in the mornings prior to any children going outside.

Complaint related: Yes
Description: Based on staff interviews, the facility failed to ensure that when staff are supervising children, they always ensure their care, protection, and guidance. Evidence: At approximately 3:20 p.m. on May 11, 2020, Child A (age 2) exited the unlatched playground gate. The child walked along the sidewalk at the front of the building, adjacent to the parking lot. A day care parent, who was of no relation to the child, saw the child from the parking lot and escorted him to the front door. Three staff on the playground did not know Child A was missing from the group until management brought it to their attention.

Plan of Correction: Disciplinary action has been taken with the three staff members (5/12/2020). Sight and sound supervision was part of a staff meeting on 6/23/2020 to retrain all staff.

Complaint related: Yes
Description: Based on staff interviews, the facility failed to have all children under 10 years of age within actual sight and sound supervision. Evidence: At approximately 3:20 p.m., on May 11, 2020, Child A (age 2) exited the unlatched playground gate, leaving the sight and sound supervision of the four staff on the playground. The child walked along the sidewalk at the front of the building, adjacent to the parking lot. A day care parent, who was of no relation to the child, saw the child from the parking lot and escorted him to the front door. The child was out of sight and sound supervision for a period of at least one minute.

Plan of Correction: Disciplinary action has been taken with the three staff members (5/12/2020). Sight and sound supervision was part of a staff meeting on 6/23/2020 to retrain all staff.
