63.2(17) License & Registration Procedures

Technical Assistance:
Technical assistance on background checks for employees who are rehired after 90 days was discussed with the provider.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

The monitoring inspection was initiated on July 23, 2020 and concluded on July 24, 2020. The director was contacted by telephone to initiate the inspection. There were 27 children in present and five staff and one administrator. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed three children's records and three staff records submitted by the facility to ensure the documentation was complete.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care Programs.

Violations:
Standard #: 22VAC40-191-60-C-2
Description: Based on a review of staff files, the center failed to ensure that a completed central registry background check had been completed within 30 days of employment.

Evidence:
1. Staff #1 central registry background check was dated 05/16/2016. Date of hire for Staff #1 was 03/05/2020.
2. Staff verified the date on the central registry background check as 05/16/2016 and the date of employment for Staff #1 as 03/05/2020.

Plan of Correction: Administration was unaware if that a staff member had left and was gone for more than 90 days that a new central registry background check must be submitted. Administration will have Staff #1 complete all proper paperwork and send out the central registry background check as soon as possible.. Administration will forward proof to the Licensing inspector within 10 business days that the background check has been initiated or completed.

Description: Based on review of staff records, the center failed to obtain fingerprint results for employees prior to date of hire.

Evidence:
1. Staff #1's fingerprint check was dated 05/20/2018. Date of re-hire for Staff #1 was 03/05/2020.
2. Staff verified date of rehire for Staff #1 being 03/5/2020, and that a new fingerprint had not been completed.

Plan of Correction: Administration was unaware if that a staff member had left and was gone for more than 90 days that a new fingerprint check must be submitted. Administration will have Staff #1 make an appointment to get new fingerprints completed as soon as possible. Administration will forward proof to the Licensing inspector within 10 business days that the background check has been initiated or completed.
