Technical Assistance:
Discussed the difference between fingerprint based background checks and central registry background checks.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on August 6, 2020 and concluded on August 7, 2020. The director was contacted by telephone to initiate the inspection. There were 25 children present and 5 staff. The Inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 3 children?s records and 3 staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility.

You will need to specify how the deficient practice will be or has been corrected. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Standard #: 22VAC40-185-130-A
Description: Based on a review of records on August 7, 2020, the center did not ensure to obtain documentation that each child has received the immunizations required by the State Board of Health before the child can attend the center.
Evidence: The record of Child #2 (DOE 04/30/19) contained documentation of immunizations dated 09/23/19.

Description: Based on a review of records on August 7, 2020, the center did not ensure to obtain documentation of a physical examination by or under the direction of a physician for each child before the child's attendance or within one month after attendance.
Evidence: 1. The record of Child #2 (DOE 04/30/19) contained documentation of a physical dated 09/23/19.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on a review of records and interview on August 7, 2020, the center did not request an out-of-state search of the child abuse and neglect registry or equivalent by the end of the 30th day of employment for each employee who has resided in any other state in the preceding five years.
Evidence: 1. The record of Staff #2 (DOH 7/6/20) did not contain documentation that an out-of-state child abuse and neglect search was requested. Staff #2 identified living in another state in the past 5 years on the staff's Sworn Disclosure Statement.
2. Administration acknowledged the out-of-state child abuse and neglect search was not requested.
