Technical Assistance:
On-line training information has been emailed to the facility and was discussed with center staff.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 08/25/2020 and concluded on 09/10/2020 in response to a self reported incident of inappropriate behavior guidance. Based on the information gathered, which included staff interview, record review and a review of center video, this self-reported incident is found to be valid.

Violations were found in the areas of forbidden action and behavior guidance. These violations are listed on the violation notice issued to the facility and were reviewed with administrative staff at the exit interview.

Violations:
Standard #: 22VAC40-185-400-B
Description: Based on staff interview and review of video footage, the facility failed to ensure that behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.


Evidence:
Video footage shows the class lining up for snack at approximately 2:28 pm on 08/21/2020.
1. Staff 1 stated that child 1 was "sitting there not wanting to go." Staff 1 further stated that child 1 "did not want to go and does not want to go with the flow."
a. Video footage shows staff 1 dragging child 1 toward the line.
2. When asked why staff 1 was dragging child 1, staff 1 stated that she could not remember why she used her hands to physically move child 1 from one place to another.

Plan of Correction: -Administration has gone over the video footage with the teacher. Alternative methods of redirection have been discussed.

-Trainings on redirection, transition times and behavior management have been provided to the staff member for refresher courses.

-Examples of appropriate ways to hold children's hands have been discussed and practiced.

Standard #: 22VAC40-185-410-1
Description: Based on video review and interview the center failed to ensure that physical punishment such as roughly handling a child shall not be administered.

Evidence:
1. A review of center video shows the following incident which occurred on 08/21/2020 at approximately 2:28 pm:
a. Child 1 is sitting on the floor in the back of the classroom while the rest of the class is lined up to depart the classroom for afternoon snack.
b. Staff 1 walks over to child 1 and leans down and takes him by his wrist. She drags him approximately 4 feet while still holding his wrist.
c. Mid way toward the line child 1 attempts to pull away from staff 1. Staff 1 then pulls child 1 to a standing position by his wrist as she drags him approximately 2 feet where he is placed at the back of the line.
2. Staff 1 stated that child 1 did not want to go to snack and that she recalled taking him by the hand and leading him to the class line.
a. Staff 1 stated, "I took him by the hand and he (child 1) resisted." "He pulled away from me and I kept holding on."
b. Staff 1 stated that child 1 told her that his arm hurt as they were walking to the lunch room for snack.

Plan of Correction: -A new lead teacher has been hired and put in the lead teacher position in place of staff 1. Staff 1 has been put in the teacher assistant position for afterschool hours.

-Various refresher course trainings as well as following the lead of another lead teacher and the watchful eye of administrator should help this incident to never occur again.
