Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A subsidy complaint inspection was initiated on 8/21/20 and concluded on 9/29/20. A subsidy complaint was received by the department on 8/12/20 regarding allegations in the areas of food allergy. The Program Administrator was contacted by telephone to conduct the investigation. The inspector emailed the Program Administrator a list of documentation required to complete the investigation. The evidence gathered during the investigation supported the allegation of non-compliance with subsidy regulations, and violations were issued. Any violations not related to the complaint, but identified during the course of the investigation can be found on the violation notice.

Violations:
Standard #: 22VAC40-665-790-F
Description: Based on interviews and a review of documentation, it was determined that the vendor did not ensure that a child with a diagnosed food allergy shall not be served any food identified in their written allergy care plan.

Evidence:
1. On August 8, 2020, child #1 was given milk by staff #1 even though child #1 has a diagnosed allergy to milk.
2. Staff #2 (Program Administrator) confirmed that staff #1 gave child #1 milk even though child #1 has a diagnosed allergy to milk.

Plan of Correction: The facility responded: The program director will ensure that all staff are knowledgeable of any known allergies of children in care including drop-in/visiting children. Staff will be verbally reminded daily by the cook of children with allergies in their classrooms during meal times. Management will be responsible for providing staff with allergy information about new children enrolled/visiting their classroom.
