63.2(17) License & Registration Procedures

Technical Assistance:
Technical Assistance was offered regarding Senate Bill 668: Background checks, including the out of state checks; and First Aid/CPR certifications.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A monitoring inspection was initiated and concluded on 10/9/20. The director was contacted by telephone to initiate the inspection. There were 48 children present and 9 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 3 children?s records and 2 staff records submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility. The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs. Violations:
Standard #: 63.2(17)-1721.1-B-4
Description: Based on record reviews and staff interview, the center did not obtain a copy of the results of a criminal history record information check, and a sex offender registry check from any state in which employees have resided in the preceding five years.
Evidence:
1. Staff # 1's date of employment was 9/9/20. Staff # 1's records indicated that she resided in Washington D.C. from 2008-2016; and this information was verified during a phone conversation between Staff # 1 and the licensing inspector. Staff # 1's record also showed that she currently resides in Maryland.
2. The center did not obtain the criminal history record check and the sex offender registry check for Staff # 1 for Washington D.C. prior to her first day of employment.
3. The center did not obtain the sex offender registry check from Maryland for Staff # 1 prior to her first day of employment.
4. Staff # 2's date of employment was 9/15/20. Staff # 2's record showed that she resided in Maryland within the last 5 years.
5. The center did not obtain the sex offender registry check from Maryland for Staff # 2 prior to her first day of employment.

Plan of Correction: The sex offender registry checks for both staff members were obtained on 10/13/20. The criminal history form for Staff # 1 has been mailed and a follow up will be conducted with the licensing inspector once they have been received.
