Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A complaint inspection was initiated on September 15, 2020 and concluded on September 18, 2020. A complaint was received by the department regarding allegations in the areas of staffing and supervision and procedures for emergencies. The director was contacted by telephone to conduct the investigation. The inspector emailed the director a list of documentation required to complete the investigation.

Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.

Description: Based on interview and documentation review, the facility did not ensure compliance with ratios of one staff member to four children for children birth to the age of 16 months.

Evidence:
1. On August 24, 2020, staff #1, in classroom #1, had five children at approximately 7:21 AM. Staff #1 had six children between approximately 7:33 AM and 8:00 AM. At approximately 8:00 AM, staff #2 arrived and at approximately 8:48 AM, staff #3 arrived in classroom #1. At approximately 2:45 PM, staff #1 signed out of classroom #1. Between approximately 2:46 PM and 3:27 PM, staff #2 and staff #3 had ten children. Between 3:28 PM and 3:59 PM, staff #2 and staff #3 had nine children. At 4:08 PM, staff #3 signed out of classroom #1. Between approximately 4:09 PM and 4:54 PM staff #2 had eight children. Between 4:55 PM and 5:05 PM staff #2 had five children.
2. On September 2, 2020 between approximately 8:47 AM and 2:36 PM, staff #1 and staff #2 had nine children in classroom #1. At 2:36 PM, staff #1 signed out of classroom #1 and staff #4 signed into classroom #1. Staff #2 and staff #4 had nine children between approximately 2:37 PM and 3:48 PM. At approximately 5:00 PM, staff #4 signed out of classroom #1. Between approximately 5:01 PM and 5:02 PM, staff # 2 had six children.
3. On September 11, 2020, staff #1, in classroom #1, had five children at 7:06 AM. Between approximately 7:14 AM and 7:35 AM, staff #1 had seven children. At approximately 7:35 AM staff #2 arrived in classroom #1. Staff #1 and staff #2 had nine children between approximately 7:38 AM and 7:59 AM. At approximately 8:00 AM, staff #3 arrived in classroom #1. At approximately 2:35 PM, staff #1 signed out of classroom #1. Between approximately 2:36 PM and 2:42 PM, staff # 2 and staff #3 had thirteen children. Administrator #1 arrived in classroom #1 at 2:42 PM and signed out of classroom #1 at 4:04 PM. Between approximately 4:05 PM and 4:10 PM, staff # 2 and staff #3 had 11 children. Staff #3 signed out of classroom #1 at 4:10 PM. Between approximately 4:10 PM and 4:13 PM, staff #2 had ten children. Between approximately 4:14 PM and 4:42 PM staff # 2 had eight children. Between approximately 4:43 PM and 5:30 PM staff #2 had seven children.
4. Staff #1 stated that on September 11, 2020, "yes we are over in classroom #1".
5. Staff #2 stated that on September 11, 2020 and other times classroom #1 has been out of ratio.
6. Administrator #1 stated that after review of documents, classroom #1 was over ratio.
