63.2(17) License & Registration Procedures

Technical Assistance:
Reviewed all background requirements for agents and employees to include new background requirements, effective 7/1/2020, for individuals who reside outside of the state of Virginia or who have resided outside of the state of Virginia in the past 5 years as well as timelines in which each background requirement must be completed. Also reviewed required timelines for children and staff records to include current leniency under the State of Emergency.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated and concluded on 10/21/2020. The director was contacted by telephone to initiate the inspection. There were 48 children present and 8 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 3 children?s records and 3 staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-191-60-C-2
Description: Based on record review, the center did not obtain a central registry check within 30 days of employment for 1 staff.

Evidence:
1. Staff #2 began employment on 8/17/20. The record for staff #2 did not contain results of a central registry check.

Plan of Correction: The center will provide documentation that the request was sent within 10 business days.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review, the center did not obtain a fingerprint-based background check for each staff member prior to their first day of employment.

Evidence:
1. Staff #1 began employment on 9/8/20. There was no documentation of a fingerprint-based background check in the record for Staff #1.
2. Staff #2 began employment on 8/17/20. The fingerprint-based background check for Staff #2 was dated 9/1/20.

Plan of Correction: The center will provide documentation that the request was sent within 10 business days.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review, the center did not obtain a copy of the results of an out of state child abuse and neglect search for one staff.

Evidence:
1. Staff #1 (start date 9/8/20) has resided outside of the state of Virginia within the past 5 years. Out of state Child Abuse and Neglect search results were not obtained for the states of Michigan and Indiana.

Plan of Correction: The center will provide documentation that the request was sent within 10 business days.
