63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A monitoring inspection was initiated on 10/28/20 and concluded on 10/29/20. The director was contacted by telephone to initiate the inspection. There were 65 children present and 15 staff present. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 4 children?s records and 7 staff records submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility. The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-185-550-D
Description: Based on a review of the emergency drill log and interview, it was determined that the facility did not ensure that a monthly practice evacuation drill is completed.

Evidence:
1. The emergency drill log did not have written documentation to demonstrate that an emergency evacuation drill was completed during the month of September 2020.
2. Staff #8 (Program Director) confirmed that there was no emergency evacuation drill completed during the month of September 2020.

Plan of Correction: The facility responded: September was our first month of operation and we thought with the fire marshal visit we did not have to complete an emergency evacuation visit for that month. Going forward, we will complete an emergency evacuation drill each month.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on a review of seven staff records, it was determined that the provider did not ensure that the center obtain a copy of the results of a criminal history record information check and sex offender registry check from any state in which the applicant has resided in the preceding five years.

Evidence:
1. The record for staff #5 (date of hire 10/13/20) did not contain documentation of a completed criminal history record information check and sex offender registry check from the state of Florida. The sworn statement or affirmation located in the record for staff #5 indicated that staff #5 lived in the state of Florida within the last 5 years.
2. Staff #8 (Program Director) reviewed the record for the staff #5, and confirmed that the criminal history record information check and sex offender registry check from the state of Florida had not been received.

Plan of Correction: The facility responded: A criminal history record information check and sex offender registry check from the state of Florida will be completed for staff #5 within the required ten days. The results will be forwarded to the Licensing Inspector when received. All new employees who have lived outside of the state of Virginia within the last five years will complete a criminal history record information check and sex offender registry check from the state in which they resided.
