The Virginia Department of Labor and Industry (DOLI) approved an Emergency Temporary Standard that requires all staff in child care settings to wear cloth face coverings.

While masks are not required for children in child care, the essential guidance issued by the Department of Social Services on 9/25/2020, based on CDC recommendations, strongly recommends that children 2 years of age and older wear a face covering. This is a best practice that will decrease the risk of COVID-19 transmission when children and caregivers are in close proximity.

Programs that remain open are to adapt service settings to align with public health recommendations, which include social distancing, wearing face coverings, implementing robust policies and procedures for hand washing and cleaning and disinfecting frequently touched surfaces and materials. Review all information from Virginia Department of Social Services (VDSS), Virginia Department of Health (VDH) and the Centers for Disease Control and Prevention (CDC) regarding COVID-19 updates.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A focused monitoring inspection was conducted on 10/16/2020 with an exit interview on 11/10/2020. The assistant director was contacted by telephone and a virtual inspection was conducted. The Inspector reviewed eight staff records and compliance with COVID-19 guidelines. The information gathered during the inspection determined non-compliance with standards that are documented on the violation notice issued to the facility.

Violations:
Standard #: 22VAC40-185-70-A
Description: Based on review of eight staff records, the facility did not ensure that each staff record contained all required information. Evidence: 1) the records for staff #2, #3, #4, #5, #6, and #8 did not have verification of age as required for the position. 2) the records for staff #3 and #7 did not have complete references as required. 3) the records for staff #2, #3, #4, and #8 did not have written information to demonstrate that the individual possesses the education, staff development, certification, and experience required by the job position.

Plan of Correction: Going forward, all staff records will have all required information.

Standard #: 22VAC40-185-340-A
Description: Based on interviews, it was determined that the facility did not ensure the care, protection, and guidance of children in care. Evidence: Interviews revealed that the facility failed to adhere to the VDSS health and safety guidelines established due to the COVID-19 pandemic to help reduce potential exposure to COVID-19. 1) Staff did not call the Virginia Department of Health or the Licensing inspector after two confirmed cases of COVID-19; 2) Staff and children are not consistently in the same groups to the greatest extent possible as staff are used as floaters, and staff assignments fluctuate day to day. 3) Staff stated that toys are not cleaned and sanitized between shared use by children. 4) Staff stated that the children do not wash their hands after using shared items. 5) Staff stated that the playground equipment is not cleaned and sanitized before and after each use.

Plan of Correction: Going forward we will ensure all COVID-19 guidelines are followed.

Standard #: 22VAC40-191-60-C-2
Description: Based on review of eight staff records, the facility did not have an original central registry report within 30 days of employment of a staff member. Evidence: the record for staff #7 (date of hire: 7/8/20) did not have documentation of Central Registry search results.

Plan of Correction: Going forward, all new hires will have required background checks in the required timeframe. There will be a new system to monitor expiration dates.

Standard #: 63.2(17)-1720.1-A
Description: Based on review of eight staff records, it was determined that the facility did not have a repeat central registry report for all staff every five years as required. Evidence: The record for staff #6 had a central registry search report dated: 4/13/15.

Plan of Correction: Going forward, all new hires will have required background checks in the required timeframe. There will be a new system to monitor expiration dates.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on review of eight staff records, it was determined that not all staff had an Office of Background Investigations (OBI) fingerprinting-based criminal history record check prior to their first day of employment. Evidence: the record for staff #3 (date of hire: 11/15/19) had an OBI determination letter dated: 11/21/2019.

Plan of Correction: Going forward, all new hires will have required background checks in the required timeframe. There will be a new system to monitor expiration dates.
