63.2(17) License & Registration Procedures

Technical Assistance:
Changes to the Code of Virginia regarding out-of-state background checks for staff reviewed. These changes were effective July 1, 2020. Written information has been emailed to the licensing manager.

Comments:
This inspection was conducted by licensing staff using an alternate protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 11/10/2020 and concluded on 11/30/2020. The licensing manager was contacted by telephone to initiate the inspection. There were 30 children present and 10 staff. The program is offering virtual learning at this time. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed 3 staff records and 3 children's records submitted by the facility to ensure documentation was complete.

The information gathered during the inspection determined non-compliances with applicable law. The violations are listed on the violation notice issued to the facility.

The licensing inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care Programs.

Violations:
Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review and interview, the center failed to obtain a copy of the results of a criminal history record information check and sex offender registry check from any state in which the applicant has resided in the preceding five years. These background checks are required to be obtained prior to employment.

Evidence:
1. The results of a criminal record check, from the State of California, was not on file for staff 1.
a. The results of the California sex offender check was obtained on 12/08/2020 which is after the hire date of 07/16/2020 for staff 1.
b. Staff 1 stated on her sworn state or affirmation and during the inspection that she had resided in the State of California within the past five years.

Plan of Correction: HRCAP Human Resources staff (HR) have attempted in February 2020, to obtain the criminal record check and sex offender check for staff 1, from the State of California.

A sex offender check was obtained on 12/08/2020 and a copy has been forwarded to the inspector.

There will be another attempt by the HR staff on December 9, 2020 to obtain a criminal record check.

The results will be emailed to the Licensing Inspector as soon as it will be received.
