Technical Assistance:
The inspector discussed the following with the program director:
The center may only administer medication to a child provided that the center has obtained medication authorization forms for each medication and the medication is maintained in the original, labeled container.
Discussed standard 22VAC40-185-240 - any child for whom emergency medications have been prescribed shall always be in the care of a staff member who has satisfactorily completed the Medication Administration Training program.
The licensee has been informed that they must provide missing background check documentation within 10 business days of the inspection. Failure to do so could result in a potential enforcement action against the licensee.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A monitoring inspection was initiated on 11/18/2020 and concluded on 11/20/2020. The director was contacted by telephone to initiate the inspection. There were 34 children present and 7 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 3 children?s records and 3 staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-185-70-A
Description: Based on record review, required records were not kept for each staff person.

Evidence:
Staff#1's record (DOH:8/12/2019) does not contain two references as to their character and reputation, as well as competency required prior to the first day of employment and documentation of orientation.

Standard #: 22VAC40-185-240-D-4
Description: Based on staff interviews and review of certifications, children that require medication are not always in the care of a staff member with current MAT training.

Evidence:
There wasn't a staff member with current MAT training on site at the time of the inspection. The center currently cares for children that require daily medication and emergency medication.

Plan of Correction: Have more than 1 staff member certificated. Currently we have two staff members certificated as of 12/4/2020. On 12/14/2020 we will have a total of 5 MAT trained members.

Standard #: 22VAC40-185-260-B
Description: Based on record review and interview, the annual health inspection is expired.

Evidence:
The last health inspection was dated 10/15/2019, the center's health inspection expired on 10/15/2020.

Description: Based on record review and interview, a sworn disclosure or affirmation form was not completed prior to the staff member's first day of employment.

Evidence:
Staff#1's record (DOH: 8/12/2019) does not contain their sworn disclosure or affirmation form.

Plan of Correction: Staff member has completed all paperwork.

Standard #: 22VAC40-191-60-C-2
Description: Based on staff record review and interview, not all staff member's records contain a central registry finding required within 30 days of employment.

Evidence:
Staff#1's record (DOH: 8/12/2019) does not contain a central registry check.
Staff#3's record (DOH: 8/18/2020) does not contain a central registry check.

Plan of Correction: Staff#1's central registry check was resubmitted. Staff#3's awaiting the results for CRC.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review, the center did not obtain a fingerprint based background check for each staff member prior to their first day of employment.

Evidence:
1.Staff#1's record (DOH: 08/12/2019) does not contain the fingerprint based background check result required prior to their first day of employment.
2.Staff#3's record (DOH: 08/18/2020) does not contain the fingerprint based background check result required prior to their first day of employment.

Plan of Correction: Staff# 1 and 3 awaiting the results for fingerprint background.
