Comments:

This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A monitoring inspection was initiated on 12/08/2020 and concluded on 12/08/2020. The director was contacted by telephone to initiate the inspection. There were 49 children present and 10 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed four children?s records and four staff records submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility. Please complete the 'plan of correction' and `date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from the date of receipt. You should specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the stand(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s). The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs. The provider's responses for the 'plan of correction' were not received as of 12/21/2020 and will not appear on this Violation Notice.

Standard #:	22VAC40-185-70-A
Description:	Based on a review of four staff records on 12/08/2020, the center did not ensure that one staff record contained the required information. Evidence: 1) The licensing inspector observed two references in the record for Staff #3 (DOH: 09/06/2019). One of the references reviewed was taken over the telephone, but there was no documentation of the dates of contact. Each staff record shall include documentation that two or more references as to character and reputation as well as competency were checked before employment or volunteering. If a reference check is taken over the phone, documentation shall include dates of contact, names of persons contacted, the firms contacted, results, and signature of person making call.

Description:	Based on a review of four staff records and interview on 12/08/2020, one record did not contain the results of an out-of-state child abuse or neglect finding for one staff member who has lived outside of Virginia within the last five years. Evidence: 1) The sworn statement in the record for Staff #2 (DOH: 08/31/2020) indicated the staff member lived out of state within the last five years. 2) The record contained documentation that the request for an out-of-state child abuse or neglect finding was sent on 08/31/20. There was no documentation of additional contact for the request. 3) During interview, a member of management reported no additional attempt to obtain the results has been made for Staff #2.

Evidence: 1) The sworn statement in the record for Staff #2 (DOH: 08/31/2020) indicated the staff member lived out of state within the last five years. 2) The record did not contain the results of an out-of-state sex offender registry check. 3) During interview, a member of management reported the center did not conduct an out-of-state sex offender registry check for Staff #2.
