Comments:
The licensing inspector completed a monitoring inspection in response to a self-reported concern regarding inappropriate staff behavior and the supervision of children that occurred at the center on July 23, 2020. The Department was notified of the incident on August 7, 2020. On August 7, 2020 the licensing inspector conducted a phone interview, reviewed documentation, and initiated contact with outside agencies. Documentation from an outside agency was received and reviewed on August 27, 2020. Outside agencies, along with the licensing inspector, conducted interviews on September 1, 2020 and October 21, 2020. The investigation continued with a review of documentation on December 1, 2020 and December 4, 2020 upon receipt of documentation from outside agencies. The preponderance of the evidence gathered during the investigation supports areas of noncompliance with the licensing standards related the supervision of children.

Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Violations:
Standard #: 22VAC40-185-340-A
Description: Based on interviews and documentation review, the facility failed to ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance.

Evidence:

1. On 8/27/2020 and 11/12/2020 Staff #1 (hire date 2/2/2015) made statements to outside agencies that on 7/23/2020 he had engaged in sexual activity with Staff #2 in a classroom where children were present. Staff #1 and Staff #2 were the only staff present in the room supervising children at the time of the incident.

2. On 10/21/2020 Staff #2 (hire date 3/9/2020) made a statement to outside agencies that on 7/23/2020 sexual activity took place between herself and Staff #1 in a classroom with four children present. The ages of the children in care at the time were reported to range from 1 year to 18 months old. Staff #1 and Staff #2 were the only staff present in the room supervising children at the time of the incident.

Plan of Correction: Administration states the following: "The facility has been operating for forty years (1981). The facility has cared for hundreds of children during that time. The facility has experienced violations over that time period and has always corrected and improved. We strongly disagree with the general statement "the facility failed to ensure."

Staff #1 was delivering paint to the Toddler classroom. Staff #1 has never been assigned to the Toddler classroom. Staff #2 was in ratio (1-4) and assigned to supervise the children. The Lead teacher in the Toddler room had finished circle time around 10 am and left the classroom at 10:30 am for break, leaving Staff #2 in ratio. Staff #2 was responsible to ensure the care of the children. Staff #2 is married with two children who were attending the facility at the time. Staff #1 is married, and his wife works at the facility. The facility had no inkling or prior knowledge of any inappropriate behavior between Staff #1 and Staff #2.

Plan of Correction: The facility is currently studying for their CDA. (Currently ongoing). Staff #1 and Staff #2 have not worked at the facility since 7/23/2020. On 9/24/2020, the facility installed Vector Security camera in every classroom to be monitored by the Director or Assistant Director. (Completed). All classrooms are accessible from the main hallway. Whenever walking down, the hallway, management are always looking into classrooms. Management will walk into all classrooms hourly and initial daily check classroom form. (12/31/2020). All newly hired staff orientation includes review of sexual abuse and molestation, neglect policy, including review of DSS Abuse and Neglect Hotline. (12/30/2020). All staff will complete CWSR5691 Child Abuse Professional Development. (No later than 1/29/2021 and review annually). The facility will expand its written abuse and molestation policy and have available on file. All staff will review and sign off on updated policy. (By 1/29/2021).
