We discussed the requirements for background checks.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on December 7, 2020 and concluded on December 7, 2020. The director was contacted by video call to initiate the virtual inspection. There were twelve children present and two to threestaff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed two children?s records and four staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined there were non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-191-40-D-1-A
Description: Based on a review of records for business representatives, and interviews with administrative staff and a board officer, the center failed to obtain all required background checks within thirty days when a change occurred for a new board officer. Evidence: BE3 became a board officer February 1, 2020 and the result of the search of the Virginia Department of Social Services Registry for Child Abuse and Neglect was not with center records. Interviews confirmed that the background check was not requested.

Plan of Correction: BE3 completed the request form for the VA Central Registry search on December 8, 2020. A copy of the request form was submitted to the licensing inspector on December 10, 2020. The finding for the background check will be viewed and filed when received. A copy of the finding will be shared with the licensing inspector. In the future, background checks for new board officers will be obtained within thirty days of taking office.

Description: Based on a review of records for business representatives, and interviews with administrative staff and a board officer, the center failed to obtain all required background checks within thirty days when a change occurred for a new board officer. Evidence: BE3 became a board officer February 1, 2020 and the results of a fingerprint criminal history record check was not with any center records. Interviews confirmed that the background check was not requested.

Plan of Correction: BE3 immediately made an appointment at a fieldprint location and the finding of the criminal history check was obtained on December 11, 2020 and shared with the licensing inspector on December 15, 2020. In the future, background checks will be obtained no later than thirty days after a board member takes an office position.

Description: Based on a review of records for business representatives, and interviews with administrative staff and a board officer, the center failed to obtain all required background checks within thirty days when a change occurred for a new board officer. Evidence: BE3 became a board officer February 1, 2020 and a copy of the result of a search of the child abuse and neglect registry, or equivalent registry, from any state in which the individual has resided in the preceding five years was not located in center records. According to interviews, all required background checks were not requested and obtained.

Plan of Correction: The request for an out-of-state child abuse registry search for BE3 was initiated after the inspection on December 7, 2020 and the finding was obtained and shared with the licensing inspector on December 17, 2020. In the future, all required background checks will be requested and obtained in a timely manner when changes occur with board officers.
